Judge Marshall opened the public hearing at 10:01 AM.
Commissioner Balajka stated this was advertised and received no comments. Judge
Marshall asked for comments from the public. Mr. John O'Connell, Extension Service
Agent, said local producers are in favor of the amendment. There being no further
comments, Judge Marshall closed the public hearing at 10:02 AM.

After public hearing duly advertised in a newspaper of general circulation of the
county, on the 28th day of February, 2002, with County Judge Arlene N. Marshall presiding
an~ Commissioners Roger Galvan, Michael Balajka, H. Floyd and Kenneth Finster present
and with Shirley Foester, Deputy County Clerk, in attendance, there having come on for
hearing the matter of determining whether Calhoun County should support amendment to the
Texas Administrative Code, Title 4, Agricultural Part I, Texas Department of Agriculture,
Chapter 7, Subsection E, Section 7 .53( 1) County Special Provisions regarding application of
2-4, 0 in a multi-county region by amending its herbicide regulations by deleting the county
special provision that states: "Brazoria. Calhoun. Fort Bend. Jackson. Matagorda and
Wharton Counties. for purposes of this subsection. are considered as one unit". Upon motion
of Commissioner Michael Ball\ika, Precinct Two, and seconded by Commissioner Roger
Galvan, Precinct One, Calhoun County Commissioners' Court supports deletion of its
herbicide regulations as to the County Special Provisions.

The Facility Group requested an extension through April.
A Motion was made by Commissioner Floyd and seconded by Commission~ Balajka to

Dear Judge Marshall:

The purpose of this letter is to request an extension of our Agreement for Consulting Services with Calhoun
County to conduct a Feasibility Study of the Calhoun County Jail.
The Agreement was dated August 7, 2001, but was not fully executed until mid-October. The project kick-
off meeting and jail tour with the Committee took place on November 7, and as you know, with the
Committee's subsequent resignation, our work has essentially been on hold through no fault of ours.
As I understand it, the Jail Committee is back on board, and we look forward to continuing our work with
them on this important study. I am, however, requesting that the Agreement be extended for four months
from now, through the end of May, 2002. No additional compensation will be required or requested.

Attached is a revised fee proposal for the additional services we outlined in our leCter of January 22, 2002,
10 Judge Marshall. As you recall, the additiooal services include:
. An assessment of the c:um:nt and fuNrc space needs for County offices. courts, court support. and the
Sheriff's Departmen~
. An assessment of the existing courthouse building;
. The development and analYsis of facility options; and
. The development of construction I renovation cost estimates for each facility option.
As we discusaed, we have reduced the amount of our proposal by consolidating some of the work. to be
done, reducing the hours assigned to certain tasks, and coordinating the site worle for these additional
Scrv1.ces to coincide with our on~site work: on the Jail Feasibility Study.
Also, as we discussed, I want to reiterate that the only way we will be able to accomplish this work is
with the full cooperation of the County and court stafTinvolved with the assessment of space needs, and
with full access to all drawings, all areas of the building, and all past studi~. assessments, and
inspection repons involving the courthouse building.

AGREEMENT WITH THE FACILITY GROUP - COUNTY COURTHOUSE
STUDY
Regarding the Agreement with The Facility GIoup for additional services to study the
County Courthouse, Judge Marshall stated there has been a $27,000 reduction from the
original proposal of $87,656 and it is now $59,796. According to law, we do not need to
go out for bids. The Facility Group has sent a letter stating their proposal.
Commissioner Floyd said the letter does not state the completion date and scope of work;
it is mostly concerned with fees. Mr. Ben Comiskey said it would require a budget
amendment hearing to increase the budget. Commissioner Floyd said he was not
opposed to the Agreement but would like to know the terms of the proposal.

A Motion was made by Commissioner Balajka and seconded by Commissioner Floyd
that we enter a Letter of Intent with The Facility Group for additional services to study
the County Courthouse to be defined in a Contract with the completion date noted in
same. Commissioners Galvan, Balajka, Floyd, Finster and Judge Marshall all voted in
favor.

LOCAL OPTION PERCENTAGE HOMESTEAD EXEMPTION FOR TAX YEAR
2002
A Motion was made by Commissioner Finster and seconded by Commissioner Floyd to
adopt the Local Option Percentage Homestead Exemption for Tax Year 2002.
In discussion, Commissioner Finster asked, if the type of tax needs to be clarified. Chief
Tax Appraiser, Drew Hahn, stated it is a $64,000 exemption against their assessed
evaluation.
A Motion was made by Commissioner Finster and seconded by Commissioner Floyd to
adopt the Local Option Percentage Homestead Exemption for Tax Year 2002 as amended
to read "against assessed value following $64,000 deduction." Commissioners Galvan,
Balajka, Floyd;Finster and Judge Marshall all voted in favor.
RESOLUTION AUTHORIZING
HOMESTEAD EXEMPTION OF TWENTY PERCENT
WHEREAS, the Calhoun County Commissioners' Court has the authority to grant
an additional homestead exemption pursuant to Section 11.13 (n) of the
State Property Tax Code; and
WHEREAS, the Calhoun County Commissioners' Court desires to grant an
. additional homestead exemption to all qualified homeowners.
NOW, THEREFORE, LET IT BE RESOLVED that the Calhoun County
Commissioners' Court does hereby grant an additional homestead
exemption of twenty percent (20%) of market value and in no case less
than five thousand ($5,000.00) to be effective for the 2002 tax roll on all
homesteads qualifying for such an exemption, Those homeowners over
65 years or disabled will receive an additional $64,000 deduction against
total assessed value.

TAX ABATEMENT APPLICATION - LASALLE'S LANDING SUBDIVISION IN
PCT #3
The Court discussed the tax abatement application and letter of intent from Eugene J.
Seaman for LaSalle's Landing subdivision in Pct. #3 with Ty Zeller, attorney.
Commissioner Galvan questioned Item #3 of the letter concerning improvements and
valuation.
Mr. Zeller said the Agreement has to do with individual lots and infrastructure. The City
of Port Lavaca is using the $70,000 figure because there was nothing there at the time.
Parks and etc. are planned but are not part of the lot selling price.
Drew Hahn, Chief Tax Appraiser, said usually the one making the improvements is the
seller (subdivider) but Mr. Seamans is selling the lots to Al Hogan and Hogan is doing
the improvements. The person buying the lot at the time of the sale is responsible for the
taxes. The abatement is on the improved lot. Mr. Seamans would be the one to get the
abatement. This is different from the usual abatement.
Commissioner Floyd said there are numerous variances between the application,
agreement and guidelines. He requested an agreement that complies with guidelines and
creates consistency between the application and the agreement.
Mr. Zeller said the letter specifies what he wants and an agreement can be drawn up. Mr.
Floyd said he didn't understand the value of his assessment and his commitment. He
needs to spell out the variances and tell us so we can make an assessment. Drew Hahn
said he needed a base value. Mr. Zeller said the base value would be the January 1,2002
value. Mr. Hahn stated Mr. Seaman is saying improvements include finding a builder,
etc. as he stated in his letter. This needs to be in the agreement. The Court needs to
decide if it wants a variance and state so in the agreement and the reason for the variance.
The abatement must be in by April 30, 2002.
This was re-set for the March 18, 2002 agenda.

3. Phase One of Five phases has been completed and
accepted by the City of Port Lavaca. phase One is co~prised
of 79 Lots at an approximate cost ot One Million dollars.
Phase 2 to 5 are contemplated to be built out over 2002
to 2006. This comprises a total of 350 lots. That cost ot
construction is estimated to be about Four to Five Million
dollars.
When all 350 homesites are built on, it shOUld have a
minimum taxable value ot over 35Million dollars.
There should be 30 to 50 jobs at any given time for
subdivision construction and home construction.

The implementation date is fast approaching and we are very excited about this new program. Although OASys is
very intuiti ve and easy to use, we will offer several opportunities for training. Training dates include:
. April 3'd, in conjunction with County Management Institute in Austin
. April 16lh, in conjunction with Treasurers' Conference in College Station
. May 81h, in conjunction with Auditors' Institute in Austin
. Web Conferencing dates to be announced.
There is no cost to register for the training and we tried to find dates and locations that would coincide with, but
not interrupt, conferences that you may already be planning to attend. (You are not required to attend these
conferences to participate in the training.) Invitations to the training sessions will be sent in late February, but
please mark your calendar now. Even ifyoll aren't sllre whether YOllr cOllnty will llse OASys, we strongly
encollrage YOll to attend a training session so YOll can see what the system will do before YOll make a decision.
While OASys will bring about many positive changes for the members of our pool, we recognize that there are
some counties that do not yet have access to the internet in the courthouse. If your county is in this situation, or if
you choose not to participate for other reasons, you may continue to send paper applications to T AC and we will
take care of the data entry for you.
Included in this packet are several action items that require information from the county. Please complete the
following action items and return the forms to T AC in the enclosed envelope no later than February ISlh.
1. Identify the authorized users at the County/entity. This is typically limited to those who handle the health
insurance or billing now.
2. List these users along with the requested access and privileges on the Group Request for OASys Users
Form (blue page). The county judge or group executive must sign off on this request.
3. Have each requested user complete the SHPS Web Security Agreement. SHPS is the vendor that T AC has
hired to develop and maintain OASys. To ensure the security of the data, this form is required for all users.
4. Mark your calendar for training dates. .
As the launch date approaches, we will be in touch with you several times to gather the information necessary to
complete the database, Because your response is critical, we will send these requests in red envelopes so they
will be easy for you to recognize. When you see a red envelope, please respond as quickly as possible.

OASys Access Agreement
The Texas Association of Counties Health & Employee Benefits Pool is implementing an Online Administration System (OASys) that will allow our
pool members to access and update eligibility and billing infonnation in a secure internet environment.
The County/Entity must designate the person(s) that will have access to this system and set the access privileges. The County/Entity will designate
whether a user has view onlv access or view and update access. If desired, salary infonnation may be restricted to only certain individuals.
Finally, the county may also restrict access based upon group sections. For example, if you have a probation department on your plan and they are
a separate section on the bill, you can have the contact at the probation department have access to only those employees' data.

and sign the enclosed Web Access Security Request as required by our vendor~ SHPS. Upon completion of this process, SHPS will send an initial
password to each designated and approved user. The user must then reset the password in order to access the system.

Claims totaling $830,716.83 were presented by the County Treasurer and after reading
and verifying same, a Motion was made by Commissioner Finster and seconded by
Commissioner Galvan that said claims be approved for payment. Commissioners
Galvan, Balajka, Floyd, Finster and Judge Marshall all voted in favor.
ACCOUNTS ALLOWED-HOSPITAL
Claims totaling $1,514,508.81 for Operations were presented by the County Treasurer
and after reading and verifying same, a Motion was made by Commissioner Finster and
seconded by commissioner Galvan that said claims be approved for payment.
Commissioners Galvan, Balajka, Floyd, Finster and Judge Marshall all voted in favor.
GENERAL DISCUSSION - DOW CHEMICAL PLANT TAX ABATEMENT
Commissioner Floyd said he received the Tax Abatement proposal ofDow Chemical.
Judge Marshall stated this plant is in competition with the Freeport plant for the
expansion project. The court does want to pursue this. Commissioner Floyd said as the
current Dow abatement is not successful, invite them' to Court and clear this up. Judge
Marshall discussed prior arrangements and solutions for same. She had spoken with
attorney Tom Pollan about options. Commissioner Floyd said we need to determine why
the abatement is not working and ask Dow to state what they want now. Judge Marshall
said Kathy Hunt, with Dow is to get in touch with each of the commissioners.
