The Agreement was dated August 7, 2001, but was not fully executed until mid-October. The project kick- off meeting and jail tour with the Committee took place on November 7, and as you know, with the Committee's subsequent resignation, our work has essentially been on hold through no fault of ours. As I understand it, the Jail Committee is back on board, and we look forward to continuing our work with them on this important study. I am, however, requesting that the Agreement be extended for four months from now, through the end of May, 2002. No additional compensation will be required or requested. According to law, we do not need to go out for bids. The Facility Group has sent a letter stating their proposal. Commissioner Floyd said the letter does not state the completion date and scope of work; it is mostly concerned with fees. Mr. Ben Comiskey said it would require a budget amendment hearing to increase the budget. Commissioner Floyd said he was not opposed to the Agreement but would like to know the terms of the proposal. -~- A Motion was made by Commissioner Balajka and seconded by Commissioner Floyd that we enter a Letter of Intent with The Facility Group for additional services to study the County Courthouse to be defined in a Contract with the completion date noted in same. In discussion, Commissioner Finster asked, if the type of tax needs to be clarified. Chief Tax Appraiser, Drew Hahn, stated it is a $64,000 exemption against their assessed evaluation. A Motion was made by Commissioner Finster and seconded by Commissioner Floyd to adopt the Local Option Percentage Homestead Exemption for Tax Year 2002 as amended to read "against assessed value following $64,000 deduction." Commissioners Galvan, Balajka, Floyd;Finster and Judge Marshall all voted in favor. RESOLUTION AUTHORIZING HOMESTEAD EXEMPTION OF TWENTY PERCENT WHEREAS, the Calhoun County Commissioners' Court has the authority to grant an additional homestead exemption pursuant to Section 11.13 (n) of the State Property Tax Code; and WHEREAS, the Calhoun County Commissioners' Court desires to grant an . additional homestead exemption to all qualified homeowners. NOW, THEREFORE, LET IT BE RESOLVED that the Calhoun County Commissioners' Court does hereby grant an additional homestead exemption of twenty percent (20%) of market value and in no case less than five thousand ($5,000.00) to be effective for the 2002 tax roll on all homesteads qualifying for such an exemption, Those homeowners over 65 years or disabled will receive an additional $64,000 deduction against total assessed value. Finster Calhoun County Commissioner, Pet. 4 881 TAX ABATEMENT APPLICATION - LASALLE'S LANDING SUBDIVISION IN PCT #3 The Court discussed the tax abatement application and letter of intent from Eugene J. Seaman for LaSalle's Landing subdivision in Pct. #3 with Ty Zeller, attorney. Commissioner Galvan questioned Item #3 of the letter concerning improvements and valuation. Mr. Zeller said the Agreement has to do with individual lots and infrastructure. The City of Port Lavaca is using the $70,000 figure because there was nothing there at the time. Parks and etc. are planned but are not part of the lot selling price. Drew Hahn, Chief Tax Appraiser, said usually the one making the improvements is the seller (subdivider) but Mr. Seamans is selling the lots to Al Hogan and Hogan is doing the improvements. The person buying the lot at the time of the sale is responsible for the taxes. The abatement is on the improved lot. Mr. Seamans would be the one to get the abatement. This is different from the usual abatement. Commissioner Floyd said there are numerous variances between the application, agreement and guidelines. He requested an agreement that complies with guidelines and creates consistency between the application and the agreement. Mr. Zeller said the letter specifies what he wants and an agreement can be drawn up. Mr. Floyd said he didn't understand the value of his assessment and his commitment. He needs to spell out the variances and tell us so we can make an assessment. Drew Hahn said he needed a base value. Mr. Zeller said the base value would be the January 1,2002 value. Mr. Hahn stated Mr. Seaman is saying improvements include finding a builder, etc. as he stated in his letter. This needs to be in the agreement. The Court needs to decide if it wants a variance and state so in the agreement and the reason for the variance. The abatement must be in by April 30, 2002. Although OASys is very intuiti ve and easy to use, we will offer several opportunities for training. Training dates include: . April 3'd, in conjunction with County Management Institute in Austin . April 16lh, in conjunction with Treasurers' Conference in College Station . May 81h, in conjunction with Auditors' Institute in Austin . Web Conferencing dates to be announced. There is no cost to register for the training and we tried to find dates and locations that would coincide with, but not interrupt, conferences that you may already be planning to attend. (You are not required to attend these conferences to participate in the training.) Invitations to the training sessions will be sent in late February, but please mark your calendar now. Commissioners Galvan, Balajka, Floyd, Finster and Judge Marshall all voted in favor. ACCOUNTS ALLOWED-HOSPITAL Claims totaling $1,514,508.81 for Operations were presented by the County Treasurer and after reading and verifying same, a Motion was made by Commissioner Finster and seconded by commissioner Galvan that said claims be approved for payment. Commissioners Galvan, Balajka, Floyd, Finster and Judge Marshall all voted in favor. GENERAL DISCUSSION - DOW CHEMICAL PLANT TAX ABATEMENT Commissioner Floyd said he received the Tax Abatement proposal ofDow Chemical. Judge Marshall stated this plant is in competition with the Freeport plant for the expansion project. The court does want to pursue this. Commissioner Floyd said as the current Dow abatement is not successful, invite them' to Court and clear this up. Judge Marshall discussed prior arrangements and solutions for same. She had spoken with attorney Tom Pollan about options. Commissioner Floyd said we need to determine why the abatement is not working and ask Dow to state what they want now. Judge Marshall said Kathy Hunt, with Dow is to get in touch with each of the commissioners. e THE COURT ADJOURNED AT II :05 AM. 900
