BE IT REMEMBERED, that on this 31'` day of October, A.D., 2007 there was begun and holden
in the Commissioners' Courtroom in the County Courthouse in the City of Port Lavaca, said
County and State, at 10:00 A.M., a Special Term of the Commissioners' Court within said County
and State, and there were present on this date the following members of the Court, to -wit:

Thereupon the following proceedings were had:
Commissioner Galvan gave the Invocation and Commissioner Finster led the Pledge of Allegiance.
REQUEST BY BLACKBERRY ISLAND, L.P. FOR DRAWDOWN OF CASH DEPOSIT HELD
BY THE COUNTY AS SECURITY FOR INFRASTRUCTURE AT CARACOL SUBDIVISION,
PORT O'CONNOR, TEXAS:
A Motion was made by Commissioner Finster and seconded by Commissioner Fritsch to approve
the release of the letter of credit contingent on Blackberry placing for escrow the sum of $10,000
in AMO's trust until such time as a dispute between two contractors has been resolved, as that is
the only funds left unpaid to contractors and all of the work is complete. Commissioners Galvan,
Lyssy, Fritsch, Finster and Judge Pfeifer all voted in favor.
EXECUTIVE SESSION:
The Court, being in open session, in compliance with the pertinent provisions of the Vernon's
Texas Code Annotated, Government Code, Section 551, Subchapter D, the County Judge as
presiding officer, publicly announced at 10:05 a.m. that a closed session would now be held
under the provision of Section 551.087; a governmental body may conduct a closed meeting to
(1) Discuss or deliberate regarding commercial or financial information that the
governmental body has received from a business prospect that the governmental body seeks to
have locate, stay, or expand in or near the territory of the governmental body and with which the
governmental body is conducting economic development negotiations; or
(2) To deliberate the offer of a financial or other incentive to a business prospect described
by Subdivision (1)
The Court then went into closed session. At the end of the closed session, the meeting was
reopened to the public at 12:00 a.m. No action was taken by the Court.
Court adjourned at 12:01 a.m.
