Finster Commissioner, Precinct #4 Farleigh Sutton Deputy Clerk CALHOUN COUNTY GREENLAKE PROJECT ALLIGATOR MANAGEMENT AND NUISANCE CONTROL CONTRACT AND AUTHORIZE COUNTY JUDGE TO SIGN: This is an agreement with Janik Alligators to do a survey, which he is certified to do the survey. It's required to do a survey before you get tags. They will do a helicopter survey and a night survey with an air boat. The helicopter survey they will find a nest and rob the eggs from the nest, they can only do a small percentage of nests. Janik agrees to pay the County $200.00 for each alligator nest harvested and 50% of the funds that are received for each alligator harvested. All of the expenses are his; he does all of the leg work. This is a 3 year agreement with a 30 day escape clause in case either party wishes to cancel; if this should happen, then the party who is cancelling will need to provide 30 day written notice to the other party. Commissioner Galvan made a motion to approve Calhoun County Greenlake Project Alligator Management and Nuisance Control Contract and authorize County Judge to sign. Commissioner Fritsch seconded his motion. Commissioners Galvan, Lyssy, Fritsch, Finster and Judge Pfeifer all voted in favor. COURT ADJOURNED AT 9:02 A.M. Green Lake Alligator Management Agreement This agreement is between Janik Alligators LLC (hereinafter referred to as Janik) and Calhoun County (hereinafter referred to as County) for the management of alligators upon Calhoun County's Green Lake Project land and waters from the date of this agreement for a three year term until December 31, 2016. Janik agrees that all activities under this agreement shall be in compliance with rules established by the Texas Parks and Wildlife Department and laws of the State of Texas. Janik holds a Nuisance Control Alligator Permit No. 02 from the Texas Parks and Wildlife Department. (TWPD) Janik agrees to keep this permit current and in force at all times during the course of this agreement. Janik agrees to conduct surveys, including night count surveys and helicopter nest surveys, to effectively perform the needed alligator management and submit documentation to TPWD to secure all available alligator tags and nest stamps. All cost associated with the surveys will be the responsibility of Janik. Janik agrees to remove all alligators for which tags are received from TPWD, to remove all alligators deemed to be a nuisance, and to remove such alligator eggs as authorized by TPWD from the Green Lake land and waters. The County grants Janik and his employees authorization to enter the Green Lake Project as needed to execute this agreement. Janik shall have sole rights to receive alligator nest stamps and to harvest alligator eggs from the Green Lake Project land and waters and all costs of alligator tags and stamps shall be borne by Janik. Janik agrees to pay to the County the sum of $200.00 for each alligator nest harvested and 50% of all funds received for each alligator harvested from the Green Lake Project land and waters prior to the end of October each calendar year. Janik agrees to pay the cost of each alligator CITES tag. Janik agrees that all equipment and supply cost associated with the alligator harvest will be its responsibility. Janik agrees to provide copies of all documentation and maps showing alligator nest GPS coordinates to Calhoun County or its designated agent when submitted to TPWD. A copy of the alligator documentation required by TPWD along with sales receipts for the alligators will be provided to the County at the end of each collection season and Janik agrees to furnish the Calhoun County Auditor with any information needed to verify and confirm the payments made under this agreement. It is agreed that this agreement may be cancelled without cause by either party by providing 30 day written notice to the other party. The parties agree that this agreement shall not be changed or modified except by written agreement signed by both parties. This agreement is executed and will be performed in Calhoun County, Texas. Deficiencies or the inability to read any required information will result in rejection of an application. • The areas of information that most commonly result in rejection are landowner's name and address, location of property, and activity to be performed. • The location description should read in the format as follows: approximately 25 miles northwest of Hwy. 59 at FM 1431. This is what is described as the "Location from nearest numbered highway intersection." • Landowner information must be supplied for each property, regardless of any authorized agent listed. • An Authorized Agent is an individual authorized by the landowner to provide signed consent to manage a specified number of wildlife or exotic animals from an aircraft on certain property. If a landowner wishes to allow the aerial permit holder or employee of the helicopter company to provide signed consent, then the landowner should provide a written authorization to that individual. • The "type of management to be performed" should reflect all proposed aerial management activities. • Count/Photograph requires only the name of the species to be counted and/or photographed. The number of animals or birds is not required. • Relocate/Herd is for wildlife that needs to be relocated (i.e., one pasture to another) by herding with an aircraft. No actual possession of the wildlife takes place. • Take is the hunting and killing of certain wildlife. The law only allows the hunting of bobcats, coyotes, coyote/dog crosses, feral hogs, red foxes, and exotic animals. Some exotic animals are protected by federal law; therefore, be aware of those species when requesting authorization to take. The name of the species and the number of animals and birds must be clearly identified on the LOA. The number requested to take/hunt is the maximum number that may be taken in any single calendar year. • Capture of wildlife by the use of an aircraft is when actual possession of wildlife takes place. The name of the species and the number of animals and birds must be clearly identified on the LOA. The capture LOA is valid until the capture activity is complete or expiration date of the LOA, whichever is sooner. For capture of all game animals and game birds, a valid DMP (Deer Management Permit), TTT (Trap, Transport and Transplant), TTP (Trap, Transport and Process), or SPR (Scientific Research) Permit is REQUIRED. • Sport hunting from an aircraft is a violation of both state and federal law. Hunt includes capture, trap, take or kill or the attempt to capture, trap, take or kill. It is an offense for a person to pay, barter, or exchange anything of value to participate as a gunner or observer. (NOTE: Anytime money or anything of value changes hands for the privilege or opportunity to hunt any animal(s) from the aircraft, it will likely be considered to be sport hunting. This includes a scenario where a person at a fundraiser "purchases" or "makes a donation to the cause" for the hunting opportunity, regardless of the recipient of the donation or proceeds. The only exception would be that of a regularly paid employee of the involved AWM permitted individual or company, or landowner, who is hunting depredating animals as part of duties prescribed by his employer.) The provisions of the law governing wildlife are subject to changes by the Texas Legislature and Parks and Wildlife Commission. As changes occur, the information contained herein shall be amended to reflect the specific changes.
