and Superintendent of the Calhoun County Independent School District, Mayors, City Managers,
City Secretaries and City Clerks of the Cities of Port Lavaca, Point Comfort and Seadrift:
It is time to nominate candidates for the Board of Directors of the Calhoun County Appraisal
District for the next two-year term. The term begins January 1, 2022 and ends December 31,
2023. I have included with this letter a calendar of events for the deadlines for,action on the
part of each governing body, the calculation indicating the number of votes to which each taxing
unit is entitled and a nomination form.
The first action you should take is to nominate candidates. Nominations must be submitted
to the chief appraiser no later than October 14, 2021. You may nominate, by resolution
adopted by your governing body, one candidate for each position. All five (5) positions are up
for election. I will submit the official voting ballots with all the nominees to you no later than
October 29, 2021.

Before October 1, 2021:
Chief Appraiser will calculate and deliver to each taxing unit entitled to vote the
number of votes to which each unit is entitled. The number of votes for each taxing
unit entitled to vote is determined by the ratio of the individual taxing unit levy to
the aggregate total levy of all taxing units entitled to vote.
No later than October 14, 2021:
The Qoverniae body may nominate candidates by resolution, but must send the
results to the chief appraiser no later than October 14, 2021. You may
nominate up to 5 candidates for the appraisal district board. You may email

No later than October 29, 2021:
After receiving all timely submitted nominations the chief appraiser will prepare
the ballot by listing the names of each candidate in alpha order and distribute the
ballot to each taxing unit entitled to vote. (County, CCISD, City of Port Lavaca,
City of Seadrift and City of Point Comfort)
No later than December 14, 2021:
The governing body shall determine its vote by resolution and submit it to the
chief appraiser. Each taxing unit may cast all votes for one or distribute them
to as many candidates as desired. It takes 834 votes to assure election to the
board of directors.
No later than December 30, 2021:
The chief appraiser will count the votes, declare the 5 candidates receiving the
largest cumulative vote totals as elected and submit the results to the governing
body of each taxing unit in the District and to the candidates.

The grant application would benefit greatly from reviewing the application you made last year for Swan
Point boat ramp access and copying where appropriate. This project is pretty simple, so I think I can

The Matagorda Bay Mitigation Trust (Trust) invites qualified governmental and non-profit
entities to submit a proposal for:
2021-2022 FUNDING CYCLE PROJECTS
TO FUND ENVIRONMENTAL MITIGATION PROJECTS,
STUDIES AND INITIATIVES IN THE MATAGORDA BAY
AND SAN ANTONIO BAY ECOSYSTEMS
Electronic responses addressed to the Trustee must be received BEFORE October 18 at
5:00 PM, C.S.T, at https://www.mbmtrust.comLfns/ .All Responses must be in the Trust's
possession on or before the scheduled date and time (no late responses will be considered).
The Trust will only accept electronic deliveries.

PART I -REQUIREMENTS FOR RESPONSES
1. INTRODUCTION
The mission of Matagorda Bay Mitigation Trust is to support and fund environmental
mitigation projects, studies, and initiatives in the Matagorda Bay and San Antonio Bay
ecosystems. Its funding comes from the settlement of a July 31, 2017 federal Clean Water
Act lawsuit filed by San Antonio Bay Estuarine Waterkeeper and S. Diane Wilson against
Formosa Plastics, Corp. alleging illegal discharges from Formosa's plant located in Point
Comfort, Texas.
The Trust is requesting submissions for projects from government(s) and/or non-profit
entity(ies) with considerable experience in providing governmental and/or project delivery
services. The responses shall be submitted to the Trust electronically as a PDF file at
https://www.mbmtrust.com/rfps/.
The awarded government(s) or non-profit entity(ies) shall possess a proven track record of
using innovative approaches to providing project services. The awarded government(s) or
non-profit entity(ies) shall have the ability to accomplish all aspects of the propose projects.
The awarded government(s) or non-profit entity(ies) should be able to provide innovative
methods to deal with challenges and provide effective solutions.
2. FUNDING PRIORITIES
The purpose of this mitigation program is to research, protect, and restore the waterbodies
and surrounding ecosystems of the Matagorda Bay and San Antonio Bay Systems or the river
deltas feeding into those systems. The Trust is soliciting proposals for projects for the
benefit of these waterbodies and the public, generally for the following priorities:
• Youth Camps focused on environmental education of the local ecosystems
• Public Access Improvement, physical or visual
• Purchasing land for conservation purposes, in order to reduce runoff and other
pollution
• Environmental Research
• Environmental Advocacy, except for litigation
• Habitat Restoration
Additionally, the Trust is soliciting proposals specifically for the following priority:
• Public Education — Development, piloting and implementation of a hands-on,
interactive, coastal ecology/biology curriculum designed for middle -school
children. The curriculum should be structured such that its framework could be
reasonably integrated into the science curriculum of any Texas coastal school

3. SERVICE DESCRIPTION
The Trust is seeking proposals for the 2021-2022 FUNDING CYCLE PROJECTS.
The Trust desires to fund government(s) and non-profit entity(ies) to implement projects
that support the Funding Priorities. The successful Respondents may self -perform and/or
subcontract a portion of the work proposed in the project.
The personnel and subcontractors that the Respondent provides must be proficient in the
assigned task. The Respondent must be responsive to the work as proposed and meet the
specified project schedules. The Respondent must be able to communicate well with
external agencies and the Trust.
The projects shall be accomplished per the RFP documents and all exhibits and
Attachments identified in the table of contents.
4. MINIMUM QUALIFICATIONS
The following minimum requirements must be demonstrated in order for the submission
to be considered responsive to the Trust. Any submission received, which is determined
to not meet these mandatory requirements may be immediately disqualified and rejected as
non -responsive.
• Project must address one of the Funding Priorities.
• Experience providing products or services of similar complexity and magnitude.
• If the project involves engineering, architecture or landscape architecture, a
licensed professional certified in the State of Texas in good standing with no
debarments or discipline actions, must be assigned to project team.
• If the project involves engineering, Engineering Firm must have a Firm
Registration number issued by the Texas Board of Professional Engineers with an
active status.
• Submittal documents including a cover sheet, Application, Attachments A-B, per
the method described in Section 11. SUBMISSION FORMAT.

6. PRE -SUBMITTAL CONFERENCE
There will be no pre -submittal conference for this RFP.
7. CONTRACT TERM
A contract awarded in response to this RFP will be for up to a three (3) year period. The
Trust shall have the option, but not the obligation, to unilaterally extend the term due to
extenuating circumstances, provided both parties are in mutual agreement. All contract
extensions shall be in writing and signed by the Trustee. However, the Trust may not extend
a contract at any time if funds are unavailable, withdrawn, not approved or service is
unsatisfactory.
8. PRICING
The Trust will select a Respondent on the basis of demonstrated competence and
qualifications to perform the services and the effectiveness that the project addresses the
selected Funding Priority.
The maximum anticipated single project award amount is $400,000.00. There is no match
requirement but matching funds, in the form of in -kind services or cash, are desirable.
The negotiated prices will remain firm for the entire contract period, including any periods
of extension.
9. ADDENDA AND MODIFICATIONS
Any changes, additions, or clarifications to the RFP are made by amendments (addenda)
and will be posted at https://www.mbmtrust.com/rfps/. Any Respondent in doubt as to the
true meaning of any part of the RFP or other documents may request an interpretation from
the Trustee. At the request of the Respondent, or in the event the Trustee deems the
interpretation to be substantive, the interpretation will be made by written addendum issued
by the Trustee. Such addendum will be posted with the original RFP at
https://www.mbmtrust.com/rfps/ and will become part of the RFP package having the same
binding effect as provisions of the original RFP. It shall be the Respondent(s)'s
responsibility to ensure that they have received all Addenda in respect to this RFP.
Furthermore, Respondents are advised that they must acknowledge receipt of and comply
with each Addendum. Respondent(s)'s signature on Addenda shall be interpreted as the
Respondent's recognition and compliance to official changes as outlined by the Trust and
as such are made part of the original RFP documents. Failure of any Respondent to receive
any such addendum or interpretation shall not relieve such Respondent from its terms and

The Respondent shall properly acknowledge all addenda in the spaces provided in the
Acknowledgment (Attachment B).
10. SUBMITTAL INSTRUCTIONS
Respondent shall submit one (1) original signed document electronically. Proposals must
be received through the Trust's website https://www.mbmtrust.com/rfps/ no later than the
published date and time stated in this RFP. Submittals sent by facsimile, USPS mail or
private courier will not be accepted. Any submittal or modification received after this time
shall not be considered. Respondents should strive for early submission to avoid the
possibility of rejection for late arrival. Respondents will be notified if their proposal is
rejected due to late submission.
Each Respondent is responsible for taking the necessary steps to ensure their submission
is received by the date and time noted herein. The Trust is not responsible for delays or
technical issues, internal or external, that may result in the submission arriving after the set
time.
All submissions shall be opened in a manner that avoids disclosure of the contents to
competing Respondents and keeps the responses secret during negotiations. A public
opening will not be conducted with this process.
11. SUBMISSION FORMAT
Each submittal shall be typewritten, single spaced and submitted on 8 '/2" x 11" white paper
format. Font size shall be no less than 12-point type for all items and may be in full color.
All pages shall be numbered and should be formatted to be printed two-sided. Margins
shall be no less than 1" around the perimeter of each page. Submittals shall include, but
not limited to: coversheet, Application, attachments, resumes, section dividers, and
organization chart. Websites or URLs shall not be submitted in lieu of the electronic
submission.
Each submittal must include the sections and attachments in the Application, and each
section and attachment must be indexed and divided by tabs and indexed in a Table of
Contents page. If Respondent is proposing as a team, provide the same information for
each member of the team. The electronic submittal should be submitted in Adobe PDF as
one file and shall not exceed 15MB in order to be accepted by the Trust's website.

12. PREPARATION OF RESPONSE
Responses MUST give full name and address of Respondent, and be signed in the
Acknowledgment, Attachment B. Failure to do so will disqualify your submittal. The
person signing the response must show title or AUTHORITY TO BIND RESPONDENT
IN A CONTRACT. Entity name and authorized signature must appear on each page that
calls for this information. The legal status of the Respondent whether government or
corporation, shall also be stated in the submittal. A corporation shall execute the submittal
by its duly authorized officers in accordance with its corporate by-laws and shall also list
the state in which it is incorporated. The place of domicile of each Respondent, or the office
address in the case of a government or corporation, with county and state and telephone
number, shall be given after the signature. Any costs associated with assembling this
submittal will be at the sole expense of the Respondent.
13. WITHDRAWAL
Responses may be withdrawn prior to the due date for submission. Written notice of
withdrawal shall be provided to the Trustee. No response may be withdrawn after the
published submittal deadline without approval by the Trust.
14. TIME ALLOWED FOR ACTION TAKEN
The Trust may hold proposals for 120 days after the submittal deadline without taking
action.
15. ALTERATIONS/AMENDMENTS TO RESPONSES
Responses CANNOT be altered or amended after the submittal deadline. Alterations made
before the submittal deadline must be in writing and signed by Respondent guaranteeing
authenticity.

16. INTERPRETATIONS
Any questions concerning the requirements or scope of work with regards to this RFP shall
be directed to the Trustee for interpretation. Such interpretations, which may affect the
eventual outcome of this RFP for Respondents, shall be made available to all prospective
Respondents via Addendum posted on the website. No interpretation shall be considered
binding unless provided in writing by the Trust in accordance with paragraph entitled
"Addenda and Modifications".
17. EVALUATION PROCEDURES
The Trust's Selection Committee will conduct a comprehensive, fair and impartial
evaluation of all submittals received. Each submittal will be analyzed to determine overall
responsiveness to the Trust's funding priorities and professional qualifications and relative
experience. The Trustee reserves the right to contact any Responder, at any time, to clarify,
verify or request information with regard to any response. The evaluation process consists
of three steps:
Step 1: The Trust will evaluate the submittal in accordance with the selection criteria and
will rank the proposals on the basis of the submittals. The Trust may elect, at its
sole discretion and without obligation, to conduct oral discussions, request
clarifications, and presentations concerning the project approach and ability to
furnish the requirements during the evaluation process, and rescore submittals
based upon the interviews/presentations. The Trust reserves the right to consider
information obtained in addition to the data submitted in the response. The
selection criterion is listed below:
A. Project need and justification (FACTOR: 20%)
B. Methodology (FACTOR: 20%).
C. Potential benefit of project (FACTOR 20 %)
D. Longevity of project benefits (FACTOR: 20%).

Step 2: Upon final evaluation and scoring, the Trust will proceed to negotiate a contract
with the Respondent(s) for the selected project(s).
Step 3: Contract execution for the selected proj ect(s).
18. RIGHT TO REJECT/ AWARD
The Trust reserves the right to reject any or all responses, to waive any or all formalities or
technicalities, and to make such awards of contract(s) as may be deemed to be in the best
interest and most advantageous to the Trust, considering the relative importance and other
evaluation factors specified herein.

19. RESTRICTIONS ON COMMUNICATION
Respondent(s) are prohibited from communicating with the Trust Selection Committee
members regarding the RFP or submittals from the time the RFP has been released until
the contract is awarded. These restrictions extend to "thank you" letters, phone calls, entails
and any contact that results in the direct or indirect discussion of the RFP and/or submittal
by Respondent. Violation of this provision by Respondent and/or its agent may lead to
disqualification of Respondent's submittal from consideration.
Exceptions to the restrictions on communication with the Trust include:
A. Respondents may submit clarification requests via email to the contact below.
B. Respondents may be asked to provide responses to questions asked of them by the
Trustee after submittals are received and opened. The Trustee may request
clarification to assist in evaluating Respondent's response. The information

20. INVITATION FOR RESPONSES PREPARATION COSTS
Issuance of this RFP does not commit the Trust, in any way, to pay any costs incurred in
the preparation and submission of a response. All costs related to the preparation and
submission of this RFP shall be borne by the Respondent.
21. DEVIATION FROM SPECIFICATION/ REQUIREMENTS
Please read the requirements thoroughly and be sure that your response complies with all
requirements/specifications noted. Any variation from the RFP requirements/
specifications or the Trust's standard contract terms and conditions must be clearly
indicated in Attachment A, on a point -by -point basis, attached to and made a part of your
response. If no exceptions are noted, and you are the successful Respondent, the Trust will
require that the project(s) be performed as specified.

23. CONTRACT
The successful Respondent will be required to execute a contract using the Trust's current

with the Trust then that negotiated contract form will be the basis for contracting with that
successful Respondent for project(s) awarded under this RFP. Please indicate on

PART II —PROJECT REQUIREMENTS
1. DELIVERABLES REQUIRED UPON PROJECT COMPLETION
Deliverables will be determined based on the project selected. Examples of deliverables
that Respondents may be expected to submit are:

B. Preliminary engineering (study phase) reports
C. Environmental, archaeological, and analysis reports

F. All files and data associated with developing the deliverables, including

2. PERFORMANCE MEASURES
The successful Respondent will:
A. Submit deliverables by the deadlines agreed to in the project schedule
B. Submit monthly progress reports listing work performed for that month, invoice
amount, work anticipated the next month and an updated schedule
C. Develop and adhere to a schedule of major milestones
D. Develop and adhere to a schedule of deliverables
E. Ensure quality deliverables are produced within the project budget
F. Clearly and expeditiously communicate with the Trustee.
G. Collaborate with the Trustee if challenges arise to develop solutions that keep the
project on schedule and budget
H. Create and submit to the Trustee planning and project evaluation/progress
meeting minutes within 48 hours of such meetings.

To the extent allowed by law, the Trust shall be named as an additional insured and provide
a Waiver of Subrogation in favor of the Trust, its officials, agents, employees and
volunteers.
2. WARRANTIES
Respondents shall furnish all data pertinent to warranties or guarantees which may apply
to items in the response.
The Responder shall warrant that any equipment furnished or work performed shall be free
from defects in design, materials, workmanship, and will give successful service under the
specified operating conditions. Furthermore, the Responder agrees, upon notice from the
Trust, to make good all defects in design, materials, or performance that develop in the
materials or equipment under its intended use for at least twelve (12) months from the date
of installation and initial operation, or the manufacturer's warranty, whichever is greater
length of time.
In the event that the equipment must be returned to the factory under warranty, the
Responder shall be responsible for delivery charges both to and from the factory.
3. SUBSTITUTIONS/CANCELLATIONS
No substitutions or cancellations are permitted without the prior written approval of the
Trust.
4. INDEPENDENT CONTRACTOR
It is expressly understood and agreed by both parties hereto that the Trust is contracting
with the successful Respondent as an independent contractor. The parties hereto understand
and agree that the Trust shall not be liable for any claims which may be asserted by any
third party occurring in connection with the services to be performed by the successful

Respondent under this contract and that the successful Respondent has no authority to bind
the Trust.
5. ASSIGNMENT
Respondents are advised that the Trust shall not allow the successful Respondent to sell,
assign, transfer, or convey any part of any contract resulting from this response in whole
or in part, to a third party without the prior written approval of the Trust.
6. AGREEMENT TO HOLD HARMLESS AND INDEMNIFICATION
To the extent allowed by law, the following is required for all entities contracting with the
Trust.

7. FORCE MAJEURE
If either party shall be wholly or partially prevented from the performance of any
contractual obligation or duty by reason of or through strikes, stoppage of labor, riot, fire,
flood, acts of war, insurrection, accident, order of any court, act of God, or specific cause
reasonably beyond the party's control and not attributable to its neglect or nonfeasance, in
such event, the time for the performance of such obligation or duty shall be suspended until
such disability to perform is removed. Determination of Force Majeure shall rest solely
with the Trust.
8. JURISDICTION
Contract(s) executed as part of this RFP shall be subject to and governed under the laws of
the State of Texas. Any and all obligations and payments are due and payable in Calhoun
County, Texas.
9. VENUE
The parties agree that venue for purposes of any and all lawsuits, cause of action,
arbitration, and/or any other dispute(s) shall be in Calhoun County, Texas.
10. COMPLIANCE WITH ALLSTATE, FEDERAL, AND LOCAL LAWS
The Respondent shall comply with all State, Federal, and Local laws and requirements.
The Respondent, must comply with all applicable laws at all times, including, without
limitation, the following: (i) §36.02 of the Texas Penal Code, which prohibits bribery; (ii)
§36.09 of the Texas Penal Code, which prohibits the offering or conferring of benefits to
public servants. The Respondent shall give all notices and comply with all laws and
regulations applicable to furnishing and performance of the Contract.
11. RESPONDENT'S EMPLOYEES
Neither the Respondent nor its employees engaged in fulfilling the terms and conditions of
any awarded contract shall be employees or agents of the Trust. The method and manner
of performance of such undertakings shall be under the exclusive control of the Respondent
on the contract. The Trust shall have the right of inspection of said undertakings at any
time.
12. THREATS
Any threats made to any employee or agent of the Trust, be it verbal or written, to
discontinue the providing of item/material/services for whatever reason and/or reasons
shall be considered a breach of contract and the Trust may immediately sever the contract
with the successful Respondent.

Hog Bayou Park provides a boat ramp and bank access to Hog and Goff Bayous.
While remote, it is heavily worn. The vehicle area needs re -graveling. Access to the
bank would be improved by removing an old bulkhead and constructing new
bulkheads from the boat ramp along the accessible shoreline.
The site is susceptible to trash dumping of tires, household trash and game carcasses.
Given that Hog and Goff Bayou provide drinking water to much of Calhoun County,
improving security and reducing trash dumping is important. The proposal adds trash
bins, rules signage, and game cameras toward that end.

APPLICATION REVIEW PROCESS
OVERVIEW
The U.S. Department of Health and Human Services (HHS) is making $25.5 billion in new provider relief
funding available to healthcare providers. The Health Resources and Services Administration (HRSA),
an agency of HHS, administers the provider relief programs on behalf of HHS. HRSA is using a single
application portal to make $8.5 billion in American Rescue Plan Act (ARP) Rural payments and $17
billion in Provider Relief Fund (PRF) Phase 4 General Distribution payments.
These instructions will guide you through how to apply. The sample application form is available at
https://www.hrsa.gov/sites/default/fdes/hrsa/provi er-refief/phase4-arp-sample-application-form.Ddf.
Please note that payments are subject to the availability of funds
Requirements
The applicant must adhere to the requirements below:
Filing TEN and Subsidiaries. In general, applications must be submitted at the parent or filing tax
identification number (TIN) level (i.e., the entity that files federal income taxes). In some cases,
entities that are within a parent entity's filing TIN may wish to apply. These entities must include
additional requirements at Field 17 Annual Revenues from Patient Care Worksheet and Field 18
Organizational Structure Documentation. HRSAwill review these exceptions on a case -by -case basis.
Multiple Applications: Applicants must not submit multiple applications with the same filing TIN(s).
HRSA will not pay duplicate providers.
Comprehensive Listing of Billing and Subsidiary TENS: Applicants must include all billing TINS
under the filing TIN that provide patient care. Applicants must include an exhaustive list of TINs and
must ensure that all TINs included in the application belong to the filing TIN that is applying. HRSA
will calculate the ARP Rural and a portion of Phase 4 payments based on the submitted billing TINs.
Failure to include an exhaustive list of billing TINs that provide patient care will affect the amount of
the applicant's ARP Rural payment and Phase 4 bonus payment.
Failure to adhere to these requirements and the following instructions may
result in HRSA deeming your applicatio n ineligible for payment.

internally -generated financial statements, valuation reports that would reflect revenue, and
budget -to -actual revenues comparisons); and
3. Ensure that Field 10 Total Annual Revenues equals the adjusted revenues amount on line 4 of the
Annual Revenues Adjustments Worksheet.

Annual Revenues from Patient Care Worksheet
The applicant must complete and upload an Annual Revenues from Patient Care Worksheet if the
information in the Annual Revenues Documentation (uploaded in Field 15):
• Includes revenues that is not completely and clearly related to patient care.
• Does not clearly identify patient care versus non -patient care revenues.
• Does not clearly identify revenues attributable to the applicant.
• Indicates a complex parent entity applying on behalf of multiple subsidiaries.
• The applicant TIN does not match the TIN in the federal income tax return, audited fmancial
statements, or internally -generated financial statements.
The applicant must ensure that the worksheet:
• Breaks out the proportion of revenues from non -patient and patient care by billing TIN.
• Breaks out the patient care revenues from other revenues such as tuition, prescription sales, etc.
• Equals the total annual revenues reflected in the applicant's federal income tax return, audited
fmancial statements, or internally -generated fmancial statements, as applicable.
• Includes subsidiaries that are pharmacies or durable medical equipment (DME) suppliers in order

GuidelinesforSupportingDocumentation: For Fields 19 and 20, applicants must upload supporting
documents substantiating operating revenues and expenses reported in Fields 13.1-13.6 and 14.1 — 14.6,
respectively. Examples of supporting documents include internally -generated financial statements or a
classified trial balance groupings report.
The applicant must conform to the guidelines for supporting documentation:
The applicant verifies that all operating expenses and revenues included in the uploaded
supporting documentation is attributable to patient care according to the definition of patient care
revenue below.
Internally -generated financial statements or a classified trial balance groupings report must
clearly reconcile themselves to the claimed amounts in the application and include the following:
o Patient Care Operating Revenues
• Net patient service revenues (gross charges minus contractual adjustments)
• Exclude "other operating revenue" and non -operating revenue, such as
investment income, joint venture income, etc.
o Patient Care Operating Expenses:
• Salaries and benefits
• Supplies
• Professional services
• Administrative
• Depreciation
• Interest
o If support is broken down by individual months within a quarter, applicants must ensure
the total is equal to the respective quarterly amount.
If the applicant is applying on behalf of subsidiaries, the applicant must submit quarterly financial
information by TIN:
o Quarterly net patient revenues and quarterly patient care operating expenses must be
clearly identifiable to each individual TIN that is part of the application.
o Prescription sales revenues must be identified by quarter by TIN.
Applicants should not include quarterly payroll reports.

DEFINITIONS
"Applicant" means an individual or entity eligible to apply to Phase 4 and/or the ARP Rural Payment
distributions.
"Operating revenues from patient care" means revenues that represent amounts received for the delivery
of health care services directly to patients. Operating revenues from patient care include:
• Revenues for patient services delivered;
• Prescription sales Revenues derived through the 340B program; and
• Interest and depreciation on building and equipment used in the provision of patient care.
The following are not considered patient care revenues and must be excluded from the reported
patient care revenues figures:
• insurance settlements;
• retail, or real estate revenues (exception for nursing and assisted living facilities' real estate
revenues where resident fees are allowable);
• prescription sales revenues (exception when derived through the 340B program);
• grants or tuition;
• contractual adjustments from all third -party payors;
• charity care adjustments;
• bad debt;
• any gains and/or losses on investments;
• prior PRF payments received; and
• other pandemic assistance received, including Rural Health Clinic COVID-19 Testing funds.
"Operating expenses from patient care" means the operating expenses incurred as part of the delivery of
care, including:
• Salaries and benefits;
• Contracted and/or employed physicians;
• Medical supplies; and
• Interest and depreciations on building and equipment used in the provision of patient care.
The following are not considered patient care expenses and must be excluded from the reported
patient expenses figures:
• Any non -operating expense such as costs incurred on any rental property not used for direct
patient care (e.g., nursing and assisted living facilities' real estate costs where resident costs
are allowable),
• Contributions made; and
• Gains and/or losses on investments.
"Q1"refers to January I —March 31.
"Q3" refers to July 1 — September 30.
"Q4" refers to October 1 —December 31.
"Rural Provider" refers to an applicant's billing TIN(s) that operate in or serve patients living in the
Federal Office of Rural Health Policy's definition of a rural area, which includes:
a. All non -Metro counties.

b. All Census Tracts within a Metropolitan county that have a Rural -Urban Commuting Area
(RUCA) code of 4-10. The RUCA codes allow the identification of rural Census Tracts in
Metropolitan counties.
C. 132 large area census tracts with RUCA codes 2 or 3. These tracts are at least 400 square miles in

d. 295 outlying Metropolitan counties with no Urbanized Area population.
