Dear Commissioner Floyd,
Attached please find six (6) revised packages; one for the county judge, one for each
commissioner and one for the county clerk. The package held with the white paper clip has a
loose copy of the resolution attached, which may be used as the original for signing.
The revisions to the cover letter and the resolution are those we agreed on yesterday at
the meeting at Bob Bolleter's office.
Each package contains the following:
1. A cover letter from Bob Bolleter.
2. A copy of the proposed resolution.
3. A copy of Calhoun County Shrimpers letter by Captain Wesley Blevins to TNRCC
opposing the proposed Benner permit to discharge in Carancahua Bay.
4. A copy of the Envirorunental Defense Fund and Texas Shrimpers Association request
for contested hearing regarding the proposed Benner permit.
5. A copy of a recent letter from CBP A, which encourages participation in the upcoming
public meeting about the proposed permit.

WHEREAS, the Calhoun County Commissioner's Court recognizes that the
bays, estuaries and offshore waters in and around Calhoun County are our most important
natural resource and that both the present and future of Calhoun County depend on these
waters being kept clean and healthy, therefore
BE IT RESOLVED, that the Commissioner's Court of Calhoun County shall do
all that is within our power to protect these waters; and
BE IT FURTHER RESOLVED, that the Commissioner's Court of Calhoun
County encourages the Texas Commission on Environmental Quality, Texas General
Land Office and other relevant agencies to protect Calhoun County bays, estuaries and

Honorable County Judge and County Commissioners,
We respectfully ask the Calhoun County Commissioner's Court to consider and adopt the
attached resolution supporting clean waters.

Why now? A public meeting called by the Texas Commission on Environmental Quality
for January 14,2003 in Port Lavaca appears to be attracting widespread attention. Mr. Ronald
Benner of Palacios has applied for a permit to discharge shrimp farm waste water into
Carancahua Bay. That application has prompted several important groups to voice their
opposition. Those groups include our 300 plus petition signers, Coastal Conservation
Association (formally called GCCA), the Environmental Defense Fund with 18,000 Texas
members, and the association of Calhoun County Shrimpers as noted in an attached Jetter from
Captain Wesley Blevins of Seadrift.
The Victoria Advocate has expressed interest in doing an article about the controversy.
You will recall that Louise Popplewell had a front-page article about a previous Benner failure to
protect the environment.
Mr. Belmer proposes discharging a daily average offour million (4,000,000) gallons of
shrimp farm waste water into Carancahua Bay. That is more waste water than both Port Lavaca
and Palacios combined discharge on a daily basis, and they discharge into much larger bays. We
think Mr. Benner's application raises concern because of the possibility of potential long term
environmental damage.
As an indication of our commitment to the future we have formed a Texas non-profit
corporation and gained IRS approval as a SOI(c)(3) charitable corporation. Your support of the
resolution is greatly needed as will be your continued efforts over the coming years.

PROTEST, COMMENTS. AND REOUEST FOR HEARING
TO THE HONORABLE COMMISSIONERS
THE ENVIRONMENTAL DEFENSE FUND (EDF), MR. ALBERT GARRISON, AND
THE TEXAS SHRIMP ASSOCIATION (EDF) (Movants) respectfully file this their protest,
c.omments, and request for hearing on the application of Ronald A. Benner (Applicant), and, in
support of the request, Movants would show the following:
I. AFFECTED PERSONS
Movants will be affected adversely by the water pollutants and biological pollutants
released by the Applicant's shrimp farm to Carancahua Bay. Movants meet all relevant tests of
affected persons, including those listed in 30 T AC 855.29. They have specific interests that are
intended to be protected by Chapter 26, Texas Water Code, and that would be adversely affected
in ways not common to those of the general public.
A. Movant EOF. EOF is a nonprofit research and advocacy organizations th.t
seeks solutions to environmental problems including the conservation .nd protection ofwater,
coastal, and fishery resources of Texas, including Carancahua Bay and the area ofCarancahua
Bay into which the Applicant is and proposes to discharge. EDF has 18,000 members in Texas
including many who live on the Texas Coast and near Carancahua Bay. The interests that EDF
seeks to protect (the w.ter, coastal, and fishery resources in C.rancahu. Bay and the rights to
enjoy said resources) are germane to EDF's purposes.
In the past, EDF has t.ken a number of specific steps to reach its go.ls. including, but
not limited to:

EDF published a case study on Texas shrimp fanning.,- as part of a larger document
describing the environmental effects of aquaculture in the United States - to inform
the public and government officials about the water quality and other effects of
coastal shrimp farming in Carancahua Bay and other Texas bays;
EDF made a presentation at the 1998 World Aquaculture Society meeting on
sustainable shrimp farming practices;
EDF made a presentation at the Lower Laguna Madre Foundation's 1997 annual
meeting in BrownsviJle, Texas about the environmental affects of shrimp farming;
4. EDF is a member of a federal panel developing a shrimp virus ecological risk
assessment, which includes an assessment of the risks from Texas shrimp farms;
5 EDF played a key role in organizing an alliance of coastal citizens and
environmental groups to work with the 75~ Texas State Legislature to develop a
shrimp farming bill that would have provided needed environmental protection for"
Carancahua Bay and other Texas bays; and
6. EDF regularly participates in processes that allow the public to influence state and
federal environmental regulatory policies in Carancahua Bay and other Texas bays.

B. Movant Albert Garrison.
Mr. Albert Garrison is a member of EDF. He is a
professional fishing guide and sport fisherman. He has fished and taken clients fishing in the
area of the Applicant's shrimp farm. He is an affected person based on his uses of the area,
which will be. adversely affected by the proposed activities of the Applicant and the issuance of
the proposed permit
While the discharge point is about 15 miles from the residence of Mr. Garrison, he, like
many fishing guides travel such distances in search of trophy class spotted seatrout, redfish,
flounder, and black drum. If a fishing guide were to travel such distances only to find the water
so murky that he or she cannot fish there, the adverse economic impacts of the discharge cannot
be denied
C. Movant TSA TSA is a non-profit corporation chanered in 19S0 to protect the
interest of its members and others. TSA noW represents over 700 maritime-registry fishing
vessels, their owners, shrimp processors and associated crews and workers that make up a total

population of approximately 35,000 full time employed individuals. The interest ofTSA's

members includes the protection and enhancement of the populations of the native shrimp and
the habitat of those shrimp. Harvesting of native shrimp stocks by members ofTSA and others
has a significant impact on the State's economy, producing more than $600 million per year in
revenues. In comparison, the production value of Texas' commercial shrimp farms in 1995 was
$33 million. The members ofTSA have an interest in the protection of the native shrimp from
negative impacts of operations of shrimp fanns
In the past, TSA has taken a number of specific steps to reach its goals, including, but
not limited to:
TSA has been a participant in four Texas shrimp farm TNRCC public hearings, in
1993, J 994, 1996, and 1997;
2 TSA is a member ofa federal panel developing a shrimp virus ecological risk
assessment, which includes an assessment of the risks from Texas shrimp fanns;
3 TSA played a key role in developing shrimp farming bills during the 74" and 75"
Texas State Legislature that would have provided needed environmental protection
for Carancahua Bay and other Texas bays; and
4 TSA regularly participates in processes that allow the public to influence state and
federal environmental regulatory policies- in Carancahua Bay and other Texas bays
On behalf of its members, EDF and TSA seek to protect the coastal and aquatic
resources ofCarancahlla Bay. If issued, ti,e permit would allow significant degradation of the
water quality, habitat and aquatic species in Carancahua Bay.
EDF and TSA seek only actions oflhe Commission within the power of the Commission
to protect the interests of EDF and TSA and their members The participation of individual
members of the EDF and TSA is not required because the members seek only the same results as
EDF and TSA. and no specific relief to the benefit of any individual member.
'Movants allege and stand ready to prove that the discharges of Applicant will be
harmful to the water quality, habitat and aquatic species in Carancahua Bay, 'Carancahua Bay
has limited ability to disperse the water and biological pollutants from the extremely large
volumes of highly turbid and low oxygen discharges of the Applicant's farm because it is
shallow, warm and poorly circulated. 'The Applicant's proposed wastewater discharges to

Carancahua Bay could have negative environmental effects. 'For example, exotic shrimp
viruses could be spread to Carancahua Bay, a state designated shrimp nursery, and to wild
shrimp populations; high turbidity could kill aquatic vegetation and animals, such as sea grass
beds and oyster reefs; the bay's sportfishing potential could be diminished by high turbidity and
resultant murky water conditions; and low oxygen conditions could eliminate important aquatic
plants and animals from the Carancahua Bay ecosystem
Under both the federal and state law of standing, all Movants have sufficient basis for
standing. In Save Our Communities v. U.S. EPA, 971 F.2d 1155 (5" Cir. 1992) for example, the
Circuit Court specifically recognized that injury to a.sthetic, environmental and recreational
interests was sufficient to support standing in a water pollution case. Quoting the U.S. Supreme
Court in U.S. v S.C.R.A.P., 412 U.S. 669, 93 S. Ct. 2405 (1973), the Court also stated that the
injury need not be economic and that the threshold of injury is low for standing. Texas Courts'
require spedal injury. However, Texas laws, including TNRCC statutes, do no limit the injury
to economic ones. Ecological, scientific, recreational and other interests can be sufficient for
standing in Texas Courts (and thus agency hearings).
Finally TNRCC rules recognize that use of the impacted natural resource is part ofthe
test of an affected person. 30 T AC $55.29 (c) (5).
furthermore, Movants have special expertise to assist the Commission in evaluating the
ongoing and proposed activities of the Applicant. The Movant's interests are redressable by a
favorable ruling to change the permit to provide more restrictive discharge limitations and
require the Applicant to change its practices associated with the discharges.
II. REASONABLENESS
Movants do not seek a hearing to raise issues outside of the jurisdiction of the
Commission. Movants do not seek to raise issues other than those related to water pollution
Movants seek changes in the draft pennit. Movants seek a hearing because of the
deficiencies in the proposed permit and the history of non-compliance of the Applicant,
including the discharge of pollutants without a pennit for approximately eight years

The hearing requests of Movants arc reasonable under all relevant factors set furth lidO

J. The application dos not involve a pollution reduction project;
2 Neither the application nor project is mandate by Commission rules;
3. The location of the discharge is Carancahua Bay, an area that provides economic and
recreational benefits to members ofEDF and TSA;
4. Applicant has not asked to substitute an equivalent or more efficient control device;
5 These hearing requests are based on impacts to Movants directly related to water
pollution and to impacts of the operation ofa wastewater facility by Applicant;
6. Movants and the members of EDF and TSA are clearly impacted, as described
above, and those impacts are significant; and
7. 'The Applicant has operated since about 1990 without a penn it, despite the
knowledge that one was required. This constitutes a panem of egregious conduct
that demonstrates a consistent disregard for the regulatory process. The Applicant
has profited from its failure to obtain a pennit. It has not had to implement controls
that would have been required. It has not had to do the sampling and reporting that
would have been required
m. COMPETENT EVIDENCE
Movants seek a hearing and the opportunity to present their evidence in support of these
hearing requests. Movants are prepared to present testimony, including eKpert testimony about
the fact that the discharges of Applicant will adversely affect Carancahua Bay and the interests
of Movants.
IV. PROPER REQUEST
These requeSts for hearing meet all requirements oDD TAC b5S.21. They are timely
filed with the chief Clerk and are pursuant to rights to hearings authori~ed by the Texas Water
Code and the Texas Administrative Procedure Act.
v. COMMENTS
As comments, Movants provide this pleading. Movants have added an ..... in front of
each sentenCe above that Movants submit as 8 comment as a basis for the hearing requests.

In addition, Movants submit the following comments (and additional bases for the
hearing requests).
The permit's proposed limitations established by the TNRCC do not provide
environmental safeguards adequate to protect the coastal water quality and marine
ecosystems of the Carancahua Bay ecosystem.
2. The Harlingen Shrimp Farm permit issued by the Commission in July, 1998 contains
four key protections that should be included in the Applicant's permit: I) limitations
on wastewater discharges and pollutant inputs; 2) best management practices; 3)
third-party monitoring; and 4) wastewater toxicity testing
J Movants recommend that mass-based discharge limitations (pounds of
pollutant/day) should be included in the penn it, in addition to the draft permit's
proposed concentration-based limits (milligrams of pollutant/liter of water), for
carbonaceous biochemical oxygen demand (CBOD5), ammonia-nitrogen (NH3-N),
and total suspended solids (TSS). The use of mass-based limits encourages shrimp
famlers to reduce their discharges while concentration-based limits help to avoid
excessive concentrations of pollutants in the mixing zone where the effluent is
diluted by receiving waters, Together these limitation will help the industry
minimize its risk for contributing to coastal water quality degradation problems and
introducing biological pollutants such as exotic shrimp species and shrimp diseases.
4. The draft permit allows the Applicant to discharge more water - a daily average and
maximum of2.5 and 7.5 million gallons per day (MGD), respectively - than its
operations appear to require. Movants recommend that the discharge limitation
more accurately represent the Applicant's operations. For example, the permit
limitations should reflect the seasonal nature of the discharge - maximum August
through November.
5. mRCC proposes to limit inorganic suspended solids (lSS) instead of total
suspended solids (TSS), as the agency has required on past shrimp farm permits
Movants recommend retaining the use of TSS in order to maintain a measure of
phytoplankton which is not included in a measure of ISS. Shrimp farmers cultivate
moderate to dense ph}10plankton blooms in ponds which, when discharged in large
volumes, can degrade water quality by creating turbid and low oxygen conditions.
The Environmental Protection Agency has informed TNRCC, with regards to federal
~
penn its for St. Martin's and Harlingen shrimp fanns, that "due to lack of data to
draw a correlation between TSS and !55, the Agency agrees not to replace TSS with
!55".
6. Movants recommend that toxicity testing be an enforceable condition of the penn it
to detect the presence of harmful chemicals, toxic bacteria, and other pollutants that
are not measured in the standard discharge limitations This testing should be
conducted at least once per harvest
7. Movants recommend that TNRCC allow third-party monitoring of the farm's
operations.
8 Movants recommend that TNRCC require the use of best management practices
(8MPs) as an enforceable condition of the pennit in order to prevent or minimize the
generation of pollutants, their release, and potential release from the farm to the
state's waters. BMPs for the Applicant's shrimp fann should include the following
r~quirements:

Vegetate or otherwise stabilize earthen levees and dikes to reduce TSS and
155 resulting from e~osion.
. Consider especially sensitive habitats and animals to be affected. Effluent
discharges should not negatively impact endangered species habitat, other
important habitats, or other economic or recreational uses
. Minimize routine water exchange by maintaining high pond water quality and
using supplemental aeration as needed. The daily maximum water exchange
rate between Carancahua Bay and the farm should not exceed 5% of the
farm's total volume
. Use settling ponds to cleanse wastewater before it is discharged
. Minimize use of water amendments. For example, reduce fertilizer use and
do not use lime unless fallow pond soils are acidic There should be no
wastewater discharge for at least 30 days after pond water is fertilized
. Use a feed that gives optimum growth and feed conversion at the lowest
possible protein level, has a high sinking rate, and has high water stability
. Use feeding trays instead of broadcast feeders to manage and adjust reed
inputs

Distribute the day's ration in multiple feedings a few hours apart to improve
feed conversion and growth, and reduce accumulation of uneaten feed
. Cease feeding at least three days before harvest.
. Incorporate use of wetlands, oyster ponds, andlor fish ponds to clean or
eliminate effluent water, where appropriate
Do not remove pond sludge unless necessary. Dispose of sludge on high
ground.
Initiate and maintain biosecurity measures such as fencing and limitations of
vehicular and personnel traffic to reduce the risk of disease outbreaks and
transmission to coastal waters
Movants request timely and full response to its comments.
VI. CONCLUSIONS
WHEREFORE, Premises Considering. Movants request a hearing on the application and
that the proposed penn it be denied or revised to protect the water quality, habitat, and aquatic
life ofCarancahua Bay. Movants also seek a full and detailed response to each of the comments

Despite what you hear on the street or read in The Pori Lavaca Wave the Carancahua Bay
shrimp farm waste water discharge application has not gone away, nor has the meeting already been
held. Apparently the talk about all this was just a smoke screen. One does not have to wonder why.
State authorities have scheduled a public meeting to discuss the application on January 14,2003;
more about that later. A copy of the public notice announcing the meeting is enclosed.
A public meeting is held to allow an exchange of ideas between opponents and proponents of
controversial projects. In other words, we will have a chance to question Ronald Benner, the
applicant, along with professionals from the Texas Commission on Environmental Quality (TCEQ).
That agency is on record as favoring the application.
To be effective participants at the public meeting it is important to understand how it will be
structured. The meeting has two parts. The first part is called the "Open Discussion Period" and is
Dot for the record. This discussion period allows Mr. Benner and state professionals a chance to
respond to opinions and questions off the record.
The second part of the meeting is called the "Formal Comment Period" which is for the
record and will be recorded by the state. Only "relevant and material" issues raised during this
formal period will be used in the decision process. It will be necessary for you to restate opinions
and questions you brought up in the first part of the meeting if you wish them included for the record.
Opinions and questions you wish to offer in either session may be either spoken or written and
handed in. Written comments or questions for the record should include your name, address, how
you use the bay and the pennit number which is 04001. The period for public comment will be
closed at the end of the public meeting.
Why all the fuss? As you will recall, Ronald Benner of Palacios has submitted an application
to discharge a daily average flow of 4,000,000 gallons of shrimp farm waste water into Carancahua
Bay. According to his application, he could release as much as 8,000,000 gallons in one day as long
as he maintains a long term average not larger than 4,000,000. Either amount is more waste water
than many towns discharge. In fact this proposed discharge is greater than the combined discharge
from the cities of Port Lavaca and Palacios. Most of us oppose the discharge on the basis that the
waste water is essentiaJJy the "shrimp farm sewer". We think that it is a bad idea for both health and
environmental reasons. Now, also recall that it was this very same Ronald Benner who was
responsible for serious environmental infractions which included dumping lead acid batteries, used
electric motors, and shrimp net lead weights into Carancahua Bay waters adjacent to his shrimp fann.

Benner removed most of the items after the illegal dump site was exposed by a well documented front
page article in The Victoria Advocate. Mr. Benner also received guidance concerning legal action
from the Calhoun County Sheriff and Victoria County Health Department. Unfortunately, personnel
at our very own Texas Commission on Environmental Quality chose not to do anything about the
illegal dump.
You now see the problem. We must convince the state environmental agency not to)ssue a
discharge permit when that agency has already:
1. Declared the discharge permit to be consistent with the Coastal Management Program
goals and objectives. Refer to TCEQ Notice ofthe Benner application No. 04001
dated December 4, 2002.
2. Made the declaration of consistence with plans and goals despite full knowledge that
the applicant was responsible for an illegal dump of hazardous materials into
Carancahua Bay. We do not understand why an agency responsible for protecting the
environment is not willing to penalize those who degrade it.

Obviously we have a fight on our hands. We must make our points at this public meeting in
order to get the state to deny the application or Mr. Benner to withdraw it; otherwise we must proceed
to the next step which is called a "Contested Case Hearing". That much more formal hearing will
come some months from now and success at that time will require the full strength that comes with
being well organized and well financed. To that end, we have formed Carancahua Bay Protection
Association, Inc. as a Texas non-profit corporation which has been granted 501(c) (3) status by IRS.
Using this entity we can receive tax deductible donations to be used to pay lawyers specializing in
this type case. In addition to our request for contested hearing on this matter Matagorda Bay
Foundation and Environmental Defense Fund have also requested a hearing. Coastal Conservation
Association is expected to issue a strong statement against the discharge very soon and we have ask
them to request a hearing also. We also have a resolution supporting clean waters before the Calhoun
County Commissioner's Court. By the way, we plan on maintaining this organization for any
possible future challenges to the bay.
As we have said before, we have several lawyers in our group who will work to keep our
legal costs at a minimum. Never the less, one environmental law firm has given us an estimate
between $3,000 and $50,000 to represent us at the contested case hearing. We had over 300 signers
of the petition, but they did not agree to pay anything, however we believe there are enough
concerned users to raise the funds needed to protect our bay. We will also pursue the availability of
grant funds to help in the bay's defense.
Now back to the immediate problem where no money is involved. Please come to this very
important first step, the "public meeting", prepared to speak up, offer written comments, or indicate
your opposition to this permit by your presence. This meeting is scheduled Tuesday, 7:00 p.m.,
January 14,2003 at the Days Inn, 2100 North Highway 35, Port Lavaca, Texas. A large turnout
will demonstrate that we are very serious about stopping this permit.

by Benner's operation?
8. What will be done to guarantee that pollution from the shrimp fann does not hann
swimmers, fishennen or consumers of products from the bay?
9. What effect will addition of fertilizers, feed or other additives to the shrimp ponds have on
the bay?
10. Why is any discharge being pennitted when new management techniques enable
operation of a shrimp farm without discharge?

EDF published a case study on Texas shrimp fanning.,.. as part of a larger document
describing the environmental effects of aquaculture in the United States -to infonn
the public and government officials about the water quality and other effects of
coastal shrimp fanning in Carancahua Bay and other Texas bays;
EDF made a presentation at the 1998 World Aquaculture Society meeting on
sustainable shrimp fanning practices;
EDF made a presentation at the Lower Laguna Madre Foundation's 1997 annual
meeting in Brownsville, Texas about the environmental affects of shrimp farming;
4. EDF is a member of a federal panel developing a shrimp virus ecological risk
assessment, which includes an assessment of the risks from Texas shrimp farms;
5 EDF played a key role in organizing an alliance of coastal citizens and
environmental groups to work with the 75" Texas State Legislature to develop a
shrimp farming bill that would have provided needed environmental protection for'
Carancahua Bay and other Texas bays; and
6. EDF regularly participates in processes that allow the public to influence state and
federal environmental regulatory policies in Carancahua Bay and other Texas bays

B. Movant Albert Garrison. Mr. Albert Garrison is a member of EDF. He is a
professional fishing guide and sport fisherman. He has fished and taken clients fishing in the
area of the Applicant's shrimp farm. He is an affected person based on his uses of the area,
which will be adversely affected by the proposed activities of the Applicant and the issuance of
the proposed permit.
While the discharge point is about 15 miles from the residence of Mr. Garrison, he, like
many fishing guides travel such distances in search of trophy class spotted seatrout, redfish,
flounder, and black drum. If a fishing guide were to travel such distances only to find the water
so murky that he or she cannot fish there, the adverse economic impacts of the discharge cannot
be denied
C. Movant TSA TSA is a non-profit corporation chartered in 1950 to protect the
interest of its members and others. TSA now represents over 700 maritime-registry fishing
vessels, their owners, shrimp processors and associated crews and workers that make up a total
,..........
population of approximately 35,000 full time employed individuals. The interest ofTSA's
members includes the protection and enhancement of the populations of the native shrimp and
~ the habitat of those shrimp. Harvesting of native shrimp stocks by members ofTSA and others
has a significant impact on the State's economy, producing more than $600 million per year in
revenues. In comparison, the production value of Texas' commercial shrimp farms in 1995 was
$33 million. The members ofTSA have an interest in the protection of the native shrimp from
negative impacts of operations of shrimp farms

In the past, TSA has taken a number of specific steps to reach its goals, including, but
not limited to:
TSA has been a participant in four Texas shrimp farm TNRCC public hearings, in
1993,1994,1996, and 1997;
2 TSA is a member of a federal panel developing a shrimp virus ecological risk
assessment, which includes an assessment of the risks from Texas shrimp farms;
3. TSA played a key role in developing shrimp farming bills during the 74" and 75"
Texas State Legislature that would have provided needed environmental protection
for Carancahua Bay and other Texas bays; and
4 TSA regularly participates in processes that allow the public to influence state and
federal environmental regulatory policies in Carancahua Bay and other Texas bays
On behalf of its members, EDF and TSA seek to protect the coastal and aquatic
resources of Carancahua Bay. I f issued, the perm it would allow significant degradation of the
water quality, habitat and aquatic species in Carancahua Bay.
EDF arid TSA seek only actions of the Commission within the power of the Commission
to protect the interests of EDF and TSA and their members The participation of individual
members of the EDF and TSA is not required because the members seek only the same results as
EDF and TSA, and no specific relief to the benefit of any individual member.

-Movants allege and stand ready to prove that the discharges of Applicant will be
harmful to the water quality, habitat and aquatic species in Carancahua Bay. -Carancahua Bay
has limited ability to disperse the water and biological pollutants from the extremely large
volumes of highly turbid and low oxygen discharges of lhe Applicant's farm because it is
shallow, warm and poorly circulated. -The Applicant's proposed wastewater discharges to
Carancahua Bay could have negative environmental effects. *For example, exotic shrimp
r-' viruses could be spread to Carancahua Bay, a Slate designated shrimp nursery, and to wild
shrimp populations; high turbidity could kill aquatic vegetation and animals, such as sea grass
beds and oyster reefs; the bay's sportfishing potential could be diminished by high turbidity and
resultant murky water conditions; and low oxygen conditions could eliminate important aquatic
plants and animals from the Carancahua Bay ecosystem
Under both the federal and state law of standing, all Movants have sufficient basis for
standing. In Save Our Communities v. U.S. EPA, 971 F.2d1155 (5'h Cir. 1992) for example, the
Circuit Court specifically recognized that injury to aesthetic, environmental and recreational
interests was sufficient to support standing in a water pollution case. Quoting the U.S. Supreme
Court in U.S. v S.C.R.A.P., 412 U.S. 669, 93 S. Ct. 2405 (1973), the Court also stated that the
injury need not be economic and that the threshold of injury is low for standing. Texas Courts'
require special injury. However, Texas laws, including TNRCC statutes. do no limit the injury
to economic ones. Ecological, scientific, recreational and other interests can be sufficient for
standing in Texas Courts (and thus agency hearings).

Finally TNRCC rules recognize that use of the impacted natural resource is part ofthe
test of an affected person. 30 TAC $55.29 (c) (5).
Furthermore, Movants have special expertise to assist the Commission in evaluating the
ongoing and proposed activities of the Applicant. The Movant's interests are redressable by a
favorable ruling to change the permit to provide more restrictive discharge limitations and
require the Applicant to change its practices associated with the discharges
II. REASONABLENESS
Movants do not seek a hearing to raise issues outside of the jurisdiction of the
Commission. Movants do not seek to raise issues other than those related to water pollution
Movants seek changes in the draft penn it. Movants seek a hearing because of the
deficiencies in the proposed permit and the history or non-compliance of the Applicant,
including the discharge of pollutants without a penn it for approximately eight years

The hearing requests of Movants sre reasonable under all relevant fJlclor.; set fanh in.3D
TAC 5 55.3\(1)) (I).
1. The application dos not involve a pollution reduction project;
2 Neither the application nor project is mandate by Commission rules;
3. The location of the discharge is Csrancahua Bay, an area that provides economic and
recreational benefits to members of EDF and TSA;
4. Applicant has not asked to substitute an equivalent or more efficient control device;
5 These hearing requests are based on impacts to Movants directly related to water
pollution and to impacts of the operation ofa wastewater facility by Applicant;
6. Movants and the members of EDF and TSA are clearly impacted, as described
above, and those impacts are significant; and
1. 'The Applicant has operated since about 1990 without a permit, despite the
knowledge that one was required. This constitutes a pattern of egregious conduct
that demonstrates a consistent disregard for the regulatory process. The Applicant
has profited from its failure to obtain a permit. It has not had to implement controls
that would have been required. It has not had to do the sampling and reporting that
would have been required
m. COMPETENT EVIDENCE
Movants seek a hearing and the opportunity to present their evidence in support of these
hearing requests. Movants are prepared to present testimony, including expert testimony about
the fact that the discharges of Applicant will adversely affect Carancahua Bay and the interests
of Movants.
IV. PROPER REQUEST
These requests for hearing meet all requirements ofJO TAC 655.21. They are timely
filed with the chief Clerk and are pursuant to rights to hearings authorized by the Texas Water
Code and the Texas Administrative Procedure Act.
V. COMMENTS
As comments, Movants provide this pleading. Movants have added an ..... in front of
each sentence above that Movants submit as a comment as a basis for the hearing requests.

In addition, Movants submit the following comments (and additional bases for the
hearing requests).
The permit's proposed limitations established by the TNRCC do not provide
environmental safeguards adequate to protect the coastal water quality and marine
ecosystems of the Carancahua Bay ecosystem.
2. The Harlingen Shrimp Farm permit issued by the Commission in July, 1998 contains
four key protections that should be included in the Applicant's permit I) limitations
on wastewater discharges and pollutant inputs; 2) best management practices; 3)
third-party monitoring; and 4) wastewater toxicity testing
J Movants recommend that mass-based discharge limitations (pounds of
pollutant/day) should be included in the permit, in addition to the draft permit's
proposed concentration-based limits (milligrams of pollutant/liter of water), for
carbonaceous biochemical oxygen demand (CBODS), ammonia-nitrogen (NH3-N),
and total suspended solids (TSS). The use of mass-based limits encourages shrimp
farmers to reduce their discharges while concentration-based limits help to avoid
excessive concentrations of pollutants in the mixing zone where the effluent is
diluted by receiving waters Together these limitation will help the industry
minimize its risk for contributing to coastal water quality degradation problems and
introducing biological pollutants such as exotic shrimp species and shrimp diseases.
4. The draft permit allows the Applicant to discharge more water - a daily average and
maximum of2.5 and 7.S million gallons per day (MOD), respectively - than its
operations appear to require. Movants recommend that the discharge limitation
more accurately represent the Applicant's operations. For example, the permit
limitations should reflect the seasonal nature of the discharge- maximum August
through November.
5. TNRCC proposes to limit inorganic suspended solids (lSS) instead of total
suspended solids (T5S), as the agency has required on past shrimp farm permits
Movants recommend retaining the use ofTSS in order to maintain a measure of
phytoplankton which is not included in a measure of 15S. Shrimp farmers cultivate
moderate to dense phytoplankton blooms in ponds which, when discharged in large
volumes, can degrade water quality by creating turbid and low oxygen conditions.
The Environmental Protection Agency has informed TNRCC, with regards to federal
------
permits for SI. Martin's and Harlingen shrimp farms, that "due to lack of data to
draw a correlation between TSS and lSS, the Agency agrees not to replace TSS with
lSS".
6. Movants recommend that toxicity testing be an enforceable condition of the permit
to detect the presence of hannful chemicals, toxic bacteria, and other pollutants that
are not measured in the standard discharge limitations. This testing should be
conducted at least once per harvest
7. Movants recommend that TNRCC allow third-party monitoring of the farm's
operations.
8 Movants recommend that TNRCC require the use ofbeSl management practices
(BMPs) as an enforceable condition of the penn it in order to prevent or minimize the
generation of pollutants, their release, and potential release from the farm to the
Slate's waters. BMPs for the Applicant's shrimp fann should include the following
requirements:

Vegetate or otherwise stabilize earthen levees and dikes to reduce TSS and
ISS resulting from erosion.
. Consider especially sensitive habitats and animals to be affected. Effluent
discharges should not negatively impact endangered species habitat, other
important habitats, or other economic or recreational uses.
. Minimize routine water exchange by maintaining high pond water quality and
using supplemental aeration as needed. The daily maximum water exchange
rate between Carancahua Bay and the fann should not exceed 5% of the
fann's total volume
. Use settling ponds to cleanse wastewater before it is discharged
. Minimize use of water amendments. For example, reduce fertilizer use and
do not use lime unless fallow pond soils are acidic There should be no
wastewater discharge for at least 30 days after pond water is fertilized
. Use a feed that gives optimum growth and feed conversion at the lowest
possible protein level, has a high sinking rate, and has high water stability.
. Use feeding trays instead of broadcast feeders to manage and adjust feed
inputs

Distribute the day's ration in multiple feedings a few hours apart to improve
feed conversion and growth, and reduce accumulation of uneaten feed
. Cease feeding at least three days before harvest.
. Incorporate use of wetlands, oyster ponds, and/or fish ponds to clean or
eliminate effluent water, where appropriate
Do not remove pond sludge unless necessary. Dispose of sludge on high
ground.
Initiate and maintain biosecurity measures such as fencing and limitations of
vehicular and personnel traffic to reduce the risk of disease outbreaks and
transrn ission to coastal waters
