CALHOUN SOIL & WATER CONSERVATION DISTRICT #345
STATE OF TEXAS
COUNTY OF CALHOUN

WHEREAS, Calhoun County, hereinafter COUNTY, a political subdivision of the
State of Texas, has determined that the expenditure of county funds proposed herein is one
which serves a public purpose and has further determined that the State of Texas, by its
Constitution or by its. state statutes, either implicidy or explicitly, has conferred ~pon
COUNTY the authority, the power and the jurisdiction to accomplish the uses for said funds
as proposed herein, infra. Having found the above elements fully satisfied, CO UNTY may
contract with the C.ALI-lOUN SOIL & WATER CONSERVATION DISTRlCT so that
they may use said public funds for the purposes contemplated herein, but only if the
expenditure is to accomplish "county business" (which encompasses matters of general
concern to county residents) and only if COUND" assures itself that the funds to be
transferred by this contract are subject to adequate contractual or other controls to ensure
that expenditure of said county funds for the public purpose stated herein will be
accomplished and so long as COUNIT received adequate consideration for the county
funds to be provided by this contract.
WHEREAS, CALHOUN SOIL & WATER CONSERVATION DISTRlCT #345,
hereinafter referred to as CALHOUN SOIL & WATER CONSERVATION DISTillCT
#345, is engaged in various functions involving agricultural production - including livestock,
crops, aquaculture, horticulture and forestry and providing services for the betterment of
Calhoun County, and desires to enter into such a contract for the provision of certain
services for the COU.N1Y; said services being considered by both parties to this contract as
fair consideration from CALHOUN SOIL & WATER CONSERVATION DISTillCT
#345 to COUND" in exchange for the funds transferred hereby.
IT IS THEREFORE AGREED THAT:
1. Payment by County: In consideration that the services desc:cibed below to the
residents of COUNTY, CALHOUN SOIL & WATER CONSERVATION DISTillCT
#345 shall be entided to a sum not to exceed $7,750.00 per annum. Such amount shall be
disbursed by COUNTY to CALHOUN SOIL & WATER CONSERVATION DISTillCT
#345 after January 1, 2003, upon written request from CALHOUN SOIL & WA7ER
CONSERVATION DISTRlCT#J45,

2. Insurance: CALHOUN SOIL & WATER CONSERVATION DISTRlCT
#345 shall at all times maintain a policy of liability insurance for premises liability for
personal injury. The County will require documentation of General Liability insurance
coverage, with adequate limits to be determined individually, depending on exposure.

3. Services: CALHOUN SOIL & WATER CONSERVATION DISTRICT #345
shall provide servi,es to the residents of COUNTY by providing diverse services including
the following: providing secretarial help to the Natural Resource Conservation Service,
which in turn provides technical time for assistance to our local government, drainage
districts, industry, local businesses, farmers and ranchers, in addition to developing and
carrying out programs for the conservation, protection and development of soil, water, and
related plant and animal resources and shoreline erosion projects with the County.

4, Term: The Term of this contract is to begin on January 1, 2003 and end on
December 31, 2003, unless earlier terminated by either party on thirty days written notice.
5. Effectiveness: This contract is effective upon approval by Order of the Calhoun
County Commissioners' Court.
6, Relationship: The parties hereby agree that this is a contract for the
administration of the Program and hereby renounce the existence of any other relationship.
In no event shall COUNTY have any obligation or liability whatsoever with respect to any
debts, obligations or liability of CALHOUN SOIL & WA1ER CONSERVATION
DISTRICT #345, and CALHOUN SOIL & WA1ER CONSERVATION DISTRICT
#345 shall have no authority to bind COUNTY to any contract, matter or obligation. No
duties of COUNTY are delegated to CALHOUN SOIL & WA1ER CONSERVATION
DISTRICT #345 by this contract and any provision which is or may be held to be such a
delegation shall be of no force or effect.
7, Modification; Termination: This contract may be amended, modified,
terminated or released only be written instrument executed by COUNTY and CALHOUN
SOIL & WATER CONSERVATION DISTRICT #345, except as herein otherwise
provided.

8. Total Agreement: This contract is a total and complete integration of any and all
undertakings existing between the parties hereto and supersedes any prior oral or written
agreements, promises or representation between them. The headings of the various
paragraphs of this contract are for convenience only, and shall not define, interpret, affect or
prescribed the meaning and intetpretacion of the provisions of this contract.

SAN MARCOS RIVER FOUNDATION - LETTER TO STATE OFFICIALS
REGARDING GUADALUPE RIVER WATER RIGHTS APPLICATIONS
Judge Pfeifer stated he received a request from the San
Marcos River Foundation asking for a Letter of Support for
the fact the Legislature recognized the need that the
communities have along the water in certain areas and that
those needs be cons ide rated in granting or not granting
permits on the Guadalupe River; advise the Legislature or
our concerns.

Ken Morris, with Carancahua Bay Protection Association,
said he was in support of sendin$ the letter, Bill
Balboa, with Texas Parks & Wildllfe Department, Norman
Eoyd, with San Antonio Bay Eco Systems, and Jim Daily, a
retired marine biologist were in attendance, Mr, Balboa
said in estuaries, where rivers meet the Gulf, and in all
bays, shrimp, oyster and blue crab production hinges on
adequate amounts of fresh water in the bays. Mr. Boyd
stated Regional L of the Regional Water Planning Board, of
which Calhoun County is a part, has plans to make
extensive use of water rights in the Guadalupe River based
on a computer model to make predictions regarding the
amount of water available in the river and the amount of
water that will be available to flow to the estuaries, He
said it is important to realize that these are only
predictions and important to express concern over the
inflows to the estuaries because too much water from the
estuaries will change it and will affect commercial
fishing and tourism,
Judge Pfeifer read the letter addressed to The Hono~able
David Dewhurst, Lieutenant Governor of Texas regardlng San
Marcos River Foundation Application for Water Rights,
Commissioner Finster suggested the Letter of Support be
sent to the Governor as well as the other legislators,
Jim Daily said the philoso~hy of the water autho~iti~s is
any gallon of water that hlts the bay and estuarles lS
wasted water and will try to impound it and sell it to
Corpus Christi. The water is needed in the bays and
estuaries to flourish and function; the water is the life
blood of the bays and estuaries,
Commissioner Finster expressed appreciation to the
gentlemen for their interest and attenda~ce, He ~aid ~he
general public needs to be aware of and lnvolved In thls
matter,

Commissioner Balajka to authorize the County Judge to slgn
the Letter of Support read by the Judge and send it to the

Adequate inflows of fresh water from the Guadalupe River into the San Antonio Bay
system and surrounding bays is of utmost importance during dry years, to residents along
the coast.
The economy of Calhoun County depends heavily on our bay system to support our
fishing, shrimping, and tourist industries. Calhoun County Commissioners' Court asks
that you keep this in mind when granting permits to those up-stream, to pump water out
of the river. The Guadalupe and San Antonio Bay estuaries must be protected for our
state and local economy to survive.

PUBLIC HEARING - EXTEND DEADLINE FOR AERIAL APPLICATION OF
2 . 4 - D IN CALHOUN COUNTY
e
Judge Pfeifer announced the Public Hearing on extension of
the deadline for aerial application of 2,4-D in Calhoun
County was open at 10:20 A,M.
The County Extension Agent stated he had received numerous
calls regarding the moisture and rainfall which resultEd
in delays of aerial application of 2,4-D in Calnoun
County. Judge Pfeifer said he was informed by Mr, Burris
with the Texas Department of Agriculture that aerial
application can be extended to April 1st but a ten day
extension is best, The Extension Agent said ten days
would be fine if we get no more rain; Wharton County is
approved for an April 1, 2003 extension.
Dwain Nunley, a local farmer, said in the past Calhoun
County has been tied with five other counties and is in
the process of breaking away from them; Calhoun County
would like to be as Victoria County with no county
restrictions and may apply 2,4-D with permits only.
Commissioner Balajka asked the Extension Agent to follow
up on the breaking away from the five other counties.
Judge Pfeifer closed the Public Hearing at 10:23 A,M,
AERIAL APPLICATION OF 2.4-D IN CALHOUN COUNTY - EXTENSION
OF DEADLINE
A Motion was made by Commissioner Balajka and seconded by
Commissioner Galvan to extend the aerial application of
2,4-D in Calhoun County to April 1, 2003, Commissioners
Galvan, Balajka, Floyd, Finster and Judge Pfeifer all
voted in favor,

DRAINAGE PROBLEM ALONG BIG CHOCOLATE CREEK AND POSSIBLE
LITIGATION AGAINST VICTORIA COUNTY
Joe D, Brett, a local farmer and rancher, stated the flood
problem along Chocolate Creek has gone on for many years
and has not been solved, He said he learned from the Soil
Conservaton Service that this problem has been caused by
Drainage District #2 in Victoria County developing a
drainage system, They dug out Chocolate Creek with a
dragline and took out the curves and straightened them out
and dug all the tributaries into it which excellerated the
velocity of the water coming down Chocolate Creek
Watershed. The problem being they did not accomodate
Calhoun County by making the creek big enough to handle
the water, Mr, Brett learned within the last eighteen
months that the Soil Conservation Service had informed
Drainage District #2 in 1947 that Chocolate Creek and
Calhoun County were not an adequate outlet for the water,
They proceeded with the work when they were told they had
no place to go with the water, In turn, this has caused
flooding for the last 30-40 years. Mr, Brett also
received a report on a 1947 Soil Conservation Service map
showing Victoria County Drainage Districts #2 and #3 had
no adequate outlet for their water, In 1974, the So iT
Conservation Service did a study for Victoria County for
some way to slow this increased velocity of water coming
down on Calhoun County, The Soil Conservation Service
requested they put in 140 pipe drops; however, .it waB
never done,

A study by Lockwood, Andrews & Newman, engineers, was done
for Calhoun County Drainage District #11 which indicated
6/% of the water to Calhoun County originates in and comes
from Victoria County, Victoria County does not want to
take any responsibility for the waters of which they
changed the velocity.

Mr, Brett said the landowners and Drainage District #11
want to take litigation against Victoria and ask the Court
to join in with them to try to proceed with this as a
unified group; Calhoun County, Drainage District #11 and a
group of landowners who have been hurt by this for years
and get some resolution. He stated last year he and Louis
Foester met with Judge Walker of Victoria County to
disucuss this problem and informed her there was not
adquate drainage. Judge Walker never got back to them,
Mr, Edwin Wagner stated he is the grandson of J, W,
McKamey, who, in 1897, built the community of Karney which
had a post office, school, many farm buildings, a railroad
stop and several hundred residents. Mr, Wagner said J, W,
McKamey would not have built in a flood prone area, Also,
Joe Brett would not have done so, Curtis Foester"Jr, had
to build a dike around his home because of the flooding,
Chocolate Creek originates in the DaCosta area. Victoria
has grown and the Welder land has gone from pasture to
fields and the water coming has grown and comes with
greater speed. Mr. wagner said something should be done
now before the situation gets worse, He felt the only way
is to file suit against Victoria County and Victoria
County Drainage District #2.
Anne Marie Odefey, attorney for Calhoun County Drainage
District #11, stated last Tuesday Drainage District #11
took action to join with the landowners and requested the
Court to join in,
Commissioner Finster asked if they are looking at Drainage
District #2 and Victoria County, MS, Odefey replied yes,
but research will be done regarding the creation of the
drainage district. A plan for procedure is needed,
Commissioner Galvan sug~ested a joint meeting with
Victoria County Commiss~oners' Court to resolve the
problem, Commissioner Balajka said a decision of the
Court to support or not support this group is needed now.
He said the problem is also affecting Matson Addition and
moving into the Six Mile area; the affected area gets
Digger and bigger. Victoria County needs to be
accountable for their actions,
Ms, Odefey said Drainage District #11 has attemped many
times to meeting with Victoria County and Drainage
TIistrict #2 with no results.

share plan will be done.
Commissioner Finster said the County also suffers from
these waters, bridges, etc, He felt the County has a
responsibility to find a solution,
Commissioner Floyd stated this day the Court needs to
agree to participate and participation is to develop a
plan and later discussion on finances be done, Ms. Odefey
said a plan of action could be drawn up,
Commissioner Finster suggestged a Court committee work
with them, Commissioner Balajka suggested a committee
from each group,

Section 3: Hazards Identification
Primary Routes of Entry: Eye and skin contact, inhalation.
Prolonged or frequent repeated skin contact with permethrin may cause allergic reaction in some individuals. Repeated and
prolonged skin contact with piperonyl butoxide may cause skin irritation. This product may cause temporary eye irritation.
Symptoms of Acute Exposure
Large, toxic doses ofpennethrin, administered to laboratory animals, have produced central nervous system effects with
symptoms that include diarrhea, salivation, bloody nose, tremors and intennittent convulsions. Overexposure to permethrin
via inhalation also produced hyperactivity and hypersensitivity.
Section 4: First Aid Measures
Ingestion: Immediately call a physician or Poison Control Center or doctor. Do not induce vomiting unless told by a
poison control center or a doctor. Do not give any liquid to the person. Do not give anything by mouth to an unconscious
person.
Eye Contact: Immediately flush eyes with large amounts of water and continue flushing until irritation subsides. If
irritation persists, seek medical attention (based on solvent).
Skin Contact: Take off contaminated clothing. Rinse skin immediately with plenty of water for 15 to 20 minutes. Call a
Poison Control Center for treatment advice.
Inhalation: The solvent in this product has a low vapor pressure and is not expected to present an inhalation exposure
hazard during mixing and loading. Follow directions for use on product packaging when applying this product.
Note to Physician: Contains petroleum distillate - vomiting may cause aspiration hazard.

The solvent in this product may generate dense smoke when burning. Carbon monoxide, carbon dioxide and other oxides
may be generated as products of combustion.
In case of Fire
Use water fog, dry chemical, foam or C02 extinguishing media. Wear full protective clothing and self-contained breathing
apparatus. Evacuate nonessential personnel from the area to prevent human exposure to fire, smoke, fumes or products of
combustion. Prevent use of contaminated buildings, area and equipment until decontaminated. Use as little water as

Wear chemical safely glasses with side shields or chemical goggles, rubber gloves, rubber boots, long-sleeved shirt, long
pants, to prevent contact with spilled material. For small spills, cover the spill with an absorbent material such as pet litter.
Sweep up and place in an approved chemical container. Wash the spill area with water containing a strong detergent,
absorb with pet litter or other absorbent material, sweep up and place in a chemical container. Seal the container and
handle in an approved manner. Flush the area with water to remove any residue. Do not allow wash water to contaminate
water supplies.

Reproductive Hazard Potential:
Chronic/Subcbronic Toxicity Studies:
Carcinogenic Potential: Permethrin: A statistically significant increase of lung and liver tumors was observed in
female mice receiving diets containing 375 and 750 mgIKg/day over 85 weeks.
Piperonyl Butoxide: Marginally higher incidences of benign liver tumors in mice were
observed following lifetime high dose exposures. The significance of this observation is
questionable and under review. The doses at which tumors were observed greatly
exceeded human dietary intake. At anticipated dietary exposure levels, it is highly
unlikely that piperonyl butoxide would result in carcinogenic effects.
Toxicity of Other Components: The solvent in this product is classified by IARe as a Group 3 substance (''Not
classifiable as to its carcinogenicity to humans" based on inadequate animal evidence). !ARC has also concluded that there
is no evidence for the carcinogenicity of white oils when administered by routes other than by interperitoneal injection. The
solvent is not carcinogenic according to the OSHA Hazard Communication Standard.
Section 12: Ecoloeical Information
Summary of Effects: Permethrin and piperonyl butoxide are highly toxic to fish and other aquatic organisms. Do not
apply directly to water, or to areas where surface water is present or to intertidal areas below the mean high water mark
other than as instructed on the product label. Do not contaminate water by disposing of equipment wash water. Apply this
product only as specified on the label.

WHEREAS, Calhoun County (the "County"), a body corporate and politic, acting herein by
and through its Commissioners' Court, is authorized pursuant to Section 38 1.004, of the Texas
Local Government Code, to develop and administer state and local economic development
programs in order to stimulate business and commercial activity within the County, and
WHEREAS, pursuant to Section 381.004, the County is authorized to spend public funds to
finance such programs and to contract with another entity for the administration of such
programs; and
WHEREAS, the County now desires to enter into a contract with Texas Settlement Region,
whereby Texas Settlement Region will promote the heritage of Calhoun County through its Web
Site, www.texas-settlement.or-.listingthecounty.shistorical markers, and inclusion of the
County in the Texas First Settlement Visitors Guide; and
NOW, THEREFORE, the County and Texas Settlement Region do hereby covenant and
agree as follows:
\. The County finds, determines and declares that Texas Settlement Region will
develop programs and projects to attract visitors and stimulate business and
commercial activity within the County,
2, Texas Settlement Region agrees to contract with the County to administer the
Program on behalf of the County,
3. The County shall participate in the Texas Settlement Region for services received in
an amount not to exceed $1,500.00.
4, Texas Settlement Region shall use the funds received from the County only for the

regular reports to the County for the services rendered,

I want to emphasize that our request is of the greatest importance to the
mentally retarded citizens of Calhoun County. We have hired a part-time
staff member for the Calhoun County Work Activity Center, 206 S, Bauer,
Port Lavaca, Texas so that all the adult mentally retarded citizens can
adequately be served. In order to carry out this function, we must have
dependable funding.
We look forward to another successful and cooperative year with Commissioners
Court in the compassionate service to our most helpless citizens.

WHEREAS, COUNTY, a political subdiyislOn of the State of Texas, has the
authority and duty to conduct necessary investigations, enforce the la\vs and under legislative
mandate, through its district attorney, assist all victims of crime, and further, pursuant to
&264.402, Texas t'{lJ1Iiiy Code, the authoritv to establish children's advocacy centers, which
centers shall provide certain services to and support of the children of COUNTY who are
victims of child abuse and neglect, and FURTHER, that COUNn' has determined such
activities serve valuable public purposes and constitutes county business, and
WHEREAS, COUNTY, pursuant to && 264.403 and 264.406, TexaJ Family Code, has
the authority to develop, maintain and support, through the children's advocacy center, an
environment that emphasizes the best interests of abused and neglected children and that
provides investigatory' and rehabilitative sCr'irices, and further, to enter into contracts to
provide certain services to and support of the children of COUNTY who are the victims of
child abuse and neglect, and FURTHER, that COUND'has determined such activities serve
valuable public purposes, and constitute county business, and
WHEREAS, The Harbor Children's Alliance and Victim Center, a Texas nonprofit
corporation, h~"einafter referred to as THE HARBOR, is engaged in providing
investigations of child abuse and assisting the child victims of abuse and neglect, along with
their families, and desires to enter into such a contract for the provision of certain services to
and support of the children and adults of COUNTY who are victims of physical! sexual

abuse and neglect; said services being considered by both parties to this contract as fair
consideration from THE HARBOR to COU1VTY in exchange for the funds transferred
hereby. ,
IT IS THEREFORE AGREED THAT:
L Payment by County: In consideration that the services described below to the
residents of COUNTY, THE HARBOR shall be entitled to a sum not to exceed $25,000.00
per annum. Such amount shall be disbursed by COUNTY to THE H/lRBOR after January
1.2003, upon written request fat THE HARBOR.
2. Insurance: The County will require documentation of General Liabilitv
lllsurance coverage, with adequate limits to be determined individually, depending on
exposure.
3, Services: THE H/lRBOR shall provide services to the tesidents of COUNn' as
follows:
a, To provide the children and adults residing in COUNn' and surrounding
counties with a facility \vhere children and adults who are the victims of sexual
and/ or physical abuse and their non-offending family members can go fat
evaluation, intervention and counseling.
b. To ptovide the agencies and professionals of COUI\T'JY and surrounding
counties who work with abused children with a forum where they can gather and
work together in assisting victims and their families.
c. To provide a resource center for craining and education in the :lrea of
child abuse, domestic violence and victimization.
d. To provide a warm, non-threatening environment in which the vict:i..ms of
physical! sexual abuse and victimization and their families can work with law
enforcement or protection services in preparation for their court appearances.
e. To provide a location \vhere local and area law enforcement agencies and
those assisting them may obtain evidence to be used to investigate and prosecute
those accused of child abuse, domestic violence, fatnily violence and neglect.

4, IRS Classification: THE HARBOR's Internal Revenue Service, non-profit
classification is 501 (c) (3) and its IRS EIN is 74-2578679
5, Most Recent Financial and Performance Reports: THE HARBOR shall
submit to COUNTY Auditor and COUNTY Judge each a copy of THE HARBOR's most
current independent financial audit or end-of-year frnaneial report of all expenditures and
income for the period of THE HARBOR's fiscal year ending in calendar year 2002, within
GO days of the approval of this contract. THE HARBOR shall provide to COUNTI'
Auditor and COUNTY Judge each a performance teview by which THE HARBOR gives
details of services provided and clients served for the previous COUNTI7 fiscal year ending
on December 31, 2003, on or before Match 1, 2004.

7, Term: The Term of this contract is to begin on January 1, 2003 and end on
December 31, 2003, unless earlier terminated by either party on thirty days writtcn noticc.
8. Use of Funds: No moneys paid to THE HARBOR shall be expended for any
purpose other than for the provision of certain services to and support of the victims of
COUNTY who are victims of physical/sexual abuse and neglect; provides, however, thar no
exception of the person who shall conduct all of the child interviews and provide training to
volunteers.
9, Books and Records: I\ll books and records of THE HARBOR shall be open
for inspection during normal business hours to any member of the public, the Calhoun
County Auditor, and such persons as may be given that authority, in \vriting, by the
Commissioners' Court, provided, however that this clause shall in no way be construed to
override the provision of the Federal Privacy Act or other state or federal law or regulation
concerning the disclosure of confidential or privacy matters.
10, Non-Exclusion: This contract is not exclusive and COUN7Y reserves the right
to contract with additional parties for the provision of certain selllices to and support of the
victims of COUNTI7 who are victims of physical! sexual abuse and neglect in the area
covered by this contract.

11. Effectiveness: This contract is effective upon approval. by Order of the
Calhoun County Commissioners' Court.
12, Non-Discrimination: THE HARBOR agrees to operation under a policy of
non-discrimination with regard to the provision of said services. Such policy shall prohibit
discrimination on the basis of race, sex, age, religion, color, handicap, disability, national
origin, language, political affiliation or belief or other non-ment factor. ~.-\ny act of
discrimination shall constitute a material breach of this conaaet.

of those laws ot'ordinances shall constitute a material hreach of this contract.

15, Default:
a. In the event either parry shall fail to keep, observe or perform any
covenant, contract, term or provision of this contract to be keFt, absenTed or
performed by such party, respectively, and such default shall continue for a period of
ten days after notice thereof by the non-defaulting party to the other, then in anv
su,h event the non-defaulting party shall be entitled to terminate this contract.
b. No delay on the parr of either party in exercising any right, power
or privilege shall operate as a waiver thereof, nor shall any single or partial exercise
of any right, power or privilege constitute such a waiver nor exhaust the same, which
shall be continuing. No notice to or demand on either party in any case shall entitle
such party to any other or further notice or demand in similar or other
circumstances, or constitute a waiver of the rights of either party to any other or
further action in any circumstances without notice or demand.
16, Successors and Assigns: This contract shall inurc to the benefit of, and be
binding upon, the parties hereto and their respective heirs, legal representatives, successors
and assigns; provided that THE HARBOR may not assign this contract without COUNTY's
prior written consent.
17, Governing Law: This contract shall be governed by and construed and
interpreted in accordance with the laws of the State of Texas and shall be enforceable in, and
venue shall be in, Calhoun County, Texas.

18. Notices; Any notice or communication hereunder must be in writing, and may
be given by registered or certified mail; if given by registered or certified mail, same shall be
deemed to have been given and received when a registered or certified letter containing such
notice, properly addressed, with postage prepaid, is deposited in the United States mail; and
if given otherwise than by registered mail, it shaD be deemed by haven been given when
delivered to and received by the party to whom it is addressed. Such notices or
communications shall be given to the parties hereto at the addresses set forth below. ~~\ny
party hereto may at any time by giving ten days \vritten notice to the other party hereto
designate any other address in substitution of the foregoing address to which such notice or
communication shall be given.
19. Severability: If any term, covenant or condition of this contract or rhe
application thereof to any person or circumstance shall, to any extent, be invalid or
unenforceable, the remainder of this contract or the application of such term, covenant or
condition to persons or circumstances other than those as to which it is invalid or
unenforceable, shall not be affected thereby, and each tcrm, covenant or condition of this
contract shall be valid and shall be enforced to the fullest extent permitted by law,
20, Relationship: The parties hereby agree that this is a contract for the
administration of the Program and hereby renounce the existence of any other relationship.
In no event shall COUNIY have any obligation or liabiliry whatsoever with respect to any
debts, obligations or liability of THE HARBOR, and THE HARBOR shall have no
authority to bind COUI'iTY to any contract. matter or obligation. No duties of COUNTY
are delegated to THE HARBOR by this contract and any provision which is or may be held
to be such a delegation shall be of no force or effect.

21. Modification; Termination: This contract may be amended. modified.

22. Total Agreement: This contract is a total and complete integration of any and

STATE OF TEXAS
COUNTY OF CALHOUN
WHEREAS, Calhoun County, hereinafter COUNTY, a political subdivision of the
State of Texas, has detennined that the expenditure of county funds proposed herein is one
wruch serves a public purpose and has further detennined that the State of Texas, by its
Constitution or by its state statutes, either implicitly or explicitly, has conferred upon
COUNTY the authority, the power and the jurisdiction to accomplish the uses for said funds
as proposed herein, infra. Having found the above elements fully satisfied, COU]\,'Tf may
contract with a private nonprofit corporation so that they may use said public funds for the
purposes contemplated herein, but only if the expenditure is to accomplish "county
business" (which encompasses matters of general concern to county residents) and only if
COUNTY assures itself that the funds to be transferred by this contract are subject to
adequate contractual or other controls to ensure that expenditure of said county funds for
the public purpose stated herein will be accomplished and so long as COUNTY received
adequate consideration for the county funds to be provided by this contract.

WHEREAS, Gulf Bend Center, hereinafter referred to as GULF BEND CENTER
is engaged in providing services to persons with chronic and persistent mental illness and
mental retardation, including crisis response and stabilization services, outpatient mental
health services, and renders support to the county and district courts in the determination of
competency and case disposition involving persons with mental illness and mental
retardation who are involved in the criminal justice system, as well as multiple community
support services for persons with mental retardation, Gulf Bend Center is thereby providing
for the betterment of Calhoun County, and desires to enter into such a contract for the
provision of certain services for the COUNTY; said services being considered by both
parties to this contract as fair consideration from GlllfBend Center to COUNTY in exchange
for the funds transferred hereby.
IT IS THEREFORE AGREED THAT:

County Auditor Ben Comiskey stated each department head is
responsibile for keeping records for employees' vacation
time, sick leave and compensatory time on the time sheet
on a timely basis. Receiving these reports will enable
t~e AUditor to keep up with these records and perhaps this
wlll be shown on check stubs in the future. This is a
step toward the Auditor keeping the records,

contract with Cingular Wireless for a phone to be used By
Calhoun County Public Nuisance Code Enforcement Officer,

In discussion, County Auditor Ben Comiskey suggested
LaDonna Thigpen, with Emergency Management, look into
different options from different cellular com~anies and
the Court take bids to have the County deal w~th one
company for all cellular phones used by County officials,
or consider a telephone allowance for each phone needed
and let them pay their own bills,

Commissioner Precinct #2 Balajka to apply for several
grants and foundations to establish a community park in
Precinct #2. (Off of Maxwell Ditch Road) Commissioners

AIRPORT IMPROVEMENTS II FUND-CAPITAL PROJECT - AUTHORIZE
LOAN PROM GENERAL FUND
A Motion was made by Commissioner Finster and seconded by
Commissioner Galvan to authorize a loan from the General
Fund to the Capital Project-Airport Improvements II Fund
in the amount of $30,446. (County's share of project
costs per resolution passed 1-19-03 in support of Texas
Department of Transporation grant.) Commissioners Galvan,
Balajka, Floyd, Finster and Judge Pfeifer all voted in
favor.

Calhoun County Health Department will continue to provide prenatal
services at our Local Health Department to all Calhoun County
residents who qualify for Title V services. Dr. Tim McFarland is our
contracting physician and provides health care services to the clients.

I agree to conduct my Title V Fee-for-Service Project in compliance with the requirements and intent
of the Title V Maternal and Child Health (MCH) Block Grant and the Texas D1;par/ment of Health
(TDH), Associateship for Family Health as follows:
A To conduct Fee-for-Service Project activity(ies) in a culturally sensitive and
nondiscriminating manner.
B. To conduct Fee-for-Service Project activities as outlined in this renewal application's plan
and to request Program approval through the appropriate Title V Maternal and Child
Health Regional Coordinator for your service area prior to any significant departures
from this plan.
C. To return 100% of any Title V generated program income to the MCH program, which
generated the funds.
D. To screen clients for potential Medicaid eligibility, refer to Texas Department of Human
Services (TDHS) those who screen out as potentially eligible, and maintain Medicaid
denial letters on those who are denied.
E. To screen clients for potential CHIP (Children's Health Insurance Plan) eligibility, refer
those who screen out as potentially eligible, and maintain denial letter on those who are
denied. To adhere to policy manual for exceptions to referral process for adolescents
seeking family planning services or other services not covered under CHIP.

F. To provide TDH with reasonable access to all data gathered or generated through this
project.
G. To agree to share data/information generated by the project, within constraints of
confidentiality, with other area publiC health entities, local authorities and communities in
order to eliminate duplication of effort.
H. To grant TDH rights to all tangibles, patentable, or copyrightable products developed
with Federal and State funds.
I. To spend at least 25% of total allocated Title V funds for the provision of activities to

encourage family planning' clients who are considered lIunderage" after
April 1, 2003 to interact with their parents for parental consent in order
to continue those services. Calhoun County has far above the state average
in teen pregnancies and with parental consent and interaction with their teens
we may be able to see that rate drop.

EXECUTIVE SESSION - POTENTIAL PROPERTY FOR NEW COUNTY JAIL
The Court, being in open session, in compliance with the
pertinent provisions of the Vernon's Texas Code Annotated
Government Code, Section 551, Subchapter D, the County ,
Judge, as presiding officer, publicly announced at 11:49
A.M. that a closed session would now be held under the
provision of Sec. 551.072; a governmental body may conduct
a closed meeting to deliberate the purchase, exchange,
lease or value of real property in deliberation if an open
meeting would have a detrimental effect on the position of
the governmental body in negotiations with a third party.
Define potential property requirements and availability
for construction of a new county jail.
The County Judge further publicly announced that before
any final action, decision or vote is made regarding the
subject matter of said closed session, this meeting would
be reopened to the public.
The Court then went into closed session. At the end of
the closed session, the meeting was reopened to the public
at 12:05 P.M.
A Motion was made by Commissioner Floyd and seconded by
Commissioner Finster to authorize Commissioner Balajka to
obtain appraisals on the O'Neil property and the Catholic
(Church) property across the street from the Courthouse.
Commissioners Galvan, Balajka, Floyd, Finster and Judge
Pfeifer all voted in favor.
EXTENSION SERVICE - JP #1 - JP #4
MONTHLY REPORTS
The Extension Service and JP #1 presented their monthly
reports for February and JP #4 for January and February,
2003 and after reading and verifying same, a Motion was_
made by Commissioner Balajka and seconded by Commissioner
Finster to accept said reports as presented.
Commissioners Galvan, Balajka, Floyd, Finster and Judge
Pfeifer all voted in favor.

GENERAL DISCUSSION - TEXAS TRASH-OFF
Commissioner Balajka said he was approached by the
committee for clean up. Texas Trash-Off will set up at
intersection of Highway 35 and Virginia Street.
GENERAL DISCUSSION - CULVERT AND DRIVEWAY INSTALLATION
POLICY
Commissioner Finster asked the other commissioners to send
him their policy on culvert and driveway installation.
GENERAL DISCUSSION - KOOP-COX I.AWSUIT
Commissioner Floyd said he will be in deposition on March
20; Motion for summary judgement is set for April 1 and
the trial
for April 28, 2003.
ACCOUNTS ALLOWED - COUNTY
Claims tot~ling $2,058,139.78 were presented by the County
Treasurer, and after reading and verifying same, a Motion
was made by Commissioner Blajaka and seconded by
Commissioner Floyd that said claims be approved f?r
payment. Commissioners Galvan, Balajka, Floyd, F~nster
and Judge Marshall all voted in favor.
