S 419B VOL Z PG 657 JVGRANT NO. 1 SUBDIVISION - PT LAVACADEV CO SUDBLEGAL DESCRIPTION Being a 3.208 acre tract of land out of the Maximo Sanchez League, Abstract No. 35 in Calhoun County, Texas, which tract is also a portion of Lot 31 of the Port Lavaca Development Company Subdivision as recorded in Volume T, Pages 2 and 3 of the Deed Records of Calhoun County, Texas, and further being a part of that 5.8 acre tract described in deed from Oflus G. Wells, et al to Ira Swaffar, dated January 16, 1941 and recorded in Volume 41, Page 119 of the Deed Records of Calhoun County, Texas and all of a 3.16 acre tract described in deed from Ruth N. Swaffar to Olen Klump, dated January 18, 1977 and recorded in Volume 301, Page 953 of the deed records of the said county, said 3.208 acre tract being more particularly described by metes and bounds as follows: COMMENCING at a 1 inch diameter iron pipe found at the northeast corner of the said Swaffar 5.8 acre tract, at the northwest corner of a 1.57 acre tract of land described in trustee's deed dated October 26, 2000 and recorded in Volume 269, Page 139 of the Official Records of Calhoun County, Texas and at the northeast corner of a 0.878 acre tract of land described as tract 3 in deed from Janice L. Santos to Martin Comacho and Mary Lou Comacho, dated May 11, 1999 and recorded in Volume 227, Page 508 of the Official Records of Calhoun County, Texas, said point also being on the south line of a 11.757 acre tract of land described in deed to Mrs. Betty Mickle, Sr. and recorded in Volume 109, Page 989 of the said Official Records; THENCE, South 75'00'00" West , with the north line of the said Tract 3 and the south line of the said Mickle tract, at 76.86 feet pass the northwest corner of Tract 3 and the northeast corner of Tract 1 as described in the said Comacho deed, at 86.86 feet pass the northwest corner of Tract 1 and the northeast corner of Tract 2 as described in the said Camacho deed, in all a total distance of 172.86 feet to a 5/8 inch diameter iron rod (topped with a yellow plastic cap stamped "Landtech Consultants")set at the northwest corner of this tract for the POINT OF BEGINNING; THENCE, departing the south line of the said Mickle tract, South 21'15'00" East with the west line of the said Tract 2 for a distance of 499.37 feet (prior deed call 500 feet) to a 5/8 inch diameter iron rod (topped with a yellow plastic cap stamped "Landtech Consultants") set on the north line of F.M. 1090, said point being on a curve to the right whose radius equals 427.46 feet, whose interior angle equals 34'50'46" and whose long chord bears North 78'07'44" West a distance of 255.99 feet; THENCE, with the arc of said curve in the said north right—of—way line a distance of 259.97 feet to a 5/8 inch iron rod (topped with a yellow plastic cap stamped "Landtech Consultants") set at the beginning of a curve to the right whose interior angle 15'11'26", whose radius equals 543.14', and whose tangent equals 72.43 feet; THENCE, said curve to the right a distance of 144.00 feet to a 5/8 inch diameter iron rod (topped with a yellow plastic cap stamped "Landtech Consultants") set; THENCE, North 45'30'53" West for a distance of 92.68 feet to a 5/8 inch diameter iron rod (topped with a yellow plastic cap stamped "Landtech Consultants") set; THENCE, North 44'51'00" West for a distance of 215.86 feet (Prior deed calls 210.7') to a 5/8 inch diameter iron rod (topped with a yellow plastic cap stamped "Landtech Consultants") set to replace a disturbed axle found at the northwest corner of this tract, at the northwest corner of the said Swaffar 5.8 acre tract and at the southwest corner of the said Mickle 11.757 acre tract; THENCE, departing the said right—of—way line, North 75'00'00" East with the common line between the said Swaffar and Mickle tracts for a distance of 417.17 (Prior deed calls 416.6) feet to the POINT OF BEGINNING and containing 3.208 acres (139326 square feet) of land more or less.
