Commissioners' Courtroom in the County Courthouse in the City of Port Lavaca, said County and State, at

Commissioner Galvan gave the Invocation and Commissioner Finster led the Pledge to the US Flag and

BIDS FOR ASPHALTS, OILS AND EMULSIONS FOR THE PERIOD BEGINNING JANUARY 1,
2014 AND ENDING DECEMBER 31, 2014. BIDS WILL BE DUE THURSDAY, DECEMBER 5,2013
AND WILL BE CONSIDERED FOR AWARD THURSDAY, DECEMBER 12, 2013:
A Motion was made by Commissioner Lyssy and seconded by Commissioner Fritsch to approve the
specifications and authorize the County Auditor to advertise for bids for Asphalts, Oils and Emulsions for
the period beginning January 1, 2014 and ending December 31,2014. Bids will be due Thursday,
December 5, 2013 and will be considered for award Thursday, December 12, 2013. Commissioners
Galvan, Lyssy, Fritsch, Finster and Judge Pfeifer all voted in favor.
A Motion was made by Commissioner Lyssy and seconded by Commissioner Fritsch to amend the
previous Motion that was made it should be for the period beginning January 1, 2014 and ending
June 30, 2014. Commissioners Galvan, Lyssy, Fritsch, Finster and Judge Pfeifer all voted in favor.

SPECIFICATIONS FOR
ASPHALTS, OILS AND EMULSIONS
1. The County of Calhoun is requesting sealed bids for Asphalts, Oils and Emulsions as needed
by the following Road and Bridge Precincts:
Precinct #1, Fairgrounds Area or Jobsites
Precinct #2, Six Mile Area or Jobsites
Precinct #3, Olivia Area or Jobsites
Precinct #4-P, Port O'Connor Area or Jobsites
Precinct #4-S, Seadrift Area or Jobsites
2. The bid shall be in effect for a period of Six (6) Months Beginning January 1,2014 and
ending June 30,2014.
3. Materials shall meet or exceed TDOT Specifications for construction of highways, roads and
bridges. Materials shall conform to the Texas Highway Department Item #300 entitled
"Asphalt, Oils and Emulsions." (Also see Invitation to Bid form.)
The Bid Items are:

Temperature must be no lower than 1500 and no higher than 1800

*TXDOT Specifications include Temperature requirements
Specifications are not being met if products are not delivered at the required temperatures.
The award of a bid may be voided if specifications are not followed. The bid would then be
awarded to the next lowest vendor that met specifications.
Pump and hoses are to be furnished by vendor at no extra charge.
Calhoun County reserves the right to conduct random sampling of pre-qualified materials
for testing and to perform random audits of test reports. County representatives may sample
material from the manufacturing plan, terminal, shipping container and any other source
they deem necessary to insure reliability of the products.
4. Delivery shall be FOB Destination to Jobsite.
All charges (including freight) must be included in bid price.
No other charges may be added to the bid price when invoiced unless noted as an exception
on the bid form. Exceptions may void the bid.
5. NO PERSON has the authority to verbally alter these specifications. Any changes to
Specifications will be made in writing (Addendum approved by Commissioners' Court) and
sent to each person having a bid package.

*CALHOUN COUNTY will use the below formula taken from Section Four, Page 10 of the CIHCP
Handbook less any additional discounts, if any are given. MAXIMUM OF 3 PRESCRIPTIONS NOT
EXCEEDING $30 A MONTH
Prescription Drugs:
This service includes up to three prescription drugs per month. New and
refilled prescriptions count equally toward this three prescription drugs per
month total. Drugs must be prescribed by a physician or other practitioner
within the scope of practice under law.
The quantity of each prescription depends on the prescribing practice of the
Physician and the needs of the patient.
*Pavment Standard:
Use the following information and formula
. Utilizing any pharmaceutical company's database that provides average wholesale pricing, look-up the drug's
ll-digit NDC number and the quantity dispensed to determine the average wholesale price (AWP).
. Net Cost is:
Generic prescription drugs is AWP minus 50%
Brand name prescription drugs is AWP minus 15%
. The drug dispensing fee is $3.00
. The formula for computing the TDSHS Payable is:
Net Cost + drug dispensing fee = TDSHS Payable
Example: Prescription is written for 34 generic tablets
AWP for 25 tablets is $100.00.
1. $100.00 divided by 25 = $4.00 per tablet
2. $4.00 per tablet x 34 tablets (prescribed quantity) = $136.00
3. $136.00 - $68.00 (SO% for generic) = $68.00
4. $68.00 + $3.00 (dispensing fee) = $71.00 TDSHS Payable
. A payment amount may be negotiated with the provider for:
Prescription compound drugs,
Prescription drugs not found in any pharmaceutical database, or
Prescription drugs that do not have an NDC number

This agreement is by and between ~,J t:, k'c \'~t
Name of Company
hereinafter called "provider" and Calhoun County acting through their Adult Detention
Center hereinafter calleo the "Jail" and is to provide for the furnishing of food and
food stuffs to the Jail.
The effective date of this agreement is January 1. 2012 and is for a period of
one year from that date. This agreement will end on December 31,2012. This
agreement has the option to renew yearly, for up to two additional years. Each of the
two optional renewals must be approved by Commissioners' Court prior to the end
date of the preceedlng contract.
The food and non.food items to be provided are set out in the attached Food
Bid Pricing LIst and said prices will be honored for the one year period. Any items
ordered not on the attached Food Bid Pricing List shall be provided at Cost Plus
1:2..0. % basis. The Jail agrees to pay for said food, non-food items or goods
upon presentation of an invoice and verification that said food, non.food items or
goods have been delivered and received.
Provider will use its best efforts to provide quality products and good and
healthy food but makes no warranties express of Implied about their fitness for use.
Provider will provide products that are needed for inmates with high blood pressure,
diabetics or for religioUS reasons.
Deliveries will be made at specific times (at least twice a week) and in sufficient
quantities to ensure that there will be sufficient food on hand at the Jail to make and
provide all meals. Deliveries will be made between Monday and Friday between the
hours of 7:00 a.m. to 10:00 a.m. and 1 :00 p.m. to 4 p.m. in order not to disrupt the Jail
kitchen in preparing meals. Should an ordered item not arrive as ordered, or a wrong
item is delivered, provider will deliver the correct or substitute item within 24 hours
from the date the missing item was supposed to be delivered. A sales representative
from the provider shall contact the Jail Administrator or Jail Cook monthly In person,
to discusS any issues or neW products offered.

PLASTICS TO EXTEND THE TARGET COMPLETION DATE FOR THE COVERED SPORTS ARENA
BY ONE YEAR:
A Motion was made by Commissioner Galvan and seconded by Commissioner Fritsch to amend Paragraph
8 of the Fractionator II Abatement Agreement with Formosa Plastics to extend the target completion date
for the covered sports arena by one year. Commissioners Galvan, Lyssy, Fritsch, Finster and Judge
Pfeifer all voted in favor.

Dear Honorable Judge Pfeifer,
As part of the Fractionator II abatement agreement, Formosa Plastics agreed to a donation to the
County in the form of a covered sports arena to be located on Calhoun County property. At this time, it
appears as if project delays may prevent completion of the arena by the date in the agreement, June
30, 2014.
Paragraph 8 of the agreement, entitled "Donation to the County," allows for changes to this target date
through execution of a written agreement of both parties prior to June 30th, 2014, In light of the current
status of the project, Formosa Plastics Corp, Texas respectfully requests the Commissioners' Court's
consideration of an extension of one year for the target completion date,
Formosa very much appreciates the Commissioners' Court's consideration ofthis action and look
forward to working with Calhoun County in both this and future activities which improve the quality of
life in the County.

Commissioner Fritsch to Vacate and Abandon a portion of Third Street
in Seadrift, Calhoun County, Texas as shown on the following Order with exhibits
attached.

ORDER DECLARING CLOSURE OF A PORTION OF THIRD STREET
IN SEADRIFT, CALHOUN COUNTY, TEXAS
WHEREAS, on the 24th day of October, 2013, the Commissioner's Court of
Calhoun County, Texas considered the request of Kevin and Sharon Noe, being a
property owner in Precinct 4 of Calhoun County, Texas, to abandon and vacate the
following portions of Third Street in Seadrift, Calhoun County, Texas more fully
hereinafter described and as shown on the Exhibit "A" which is attached to this order and
incorporated by reference.
WHEREAS, Texas Transportation Code 9251.051 vest in the Commissioner's
Court the authority to abandon and vacate a portion of the street; and
WHEREAS, the Commissioners have not previously classified the subject street
as either a first class or second class road; and
WHEREAS, the Commissioner's actions to abandon or vacate the street have not
been enjoined or sought to be enjoined by any party; and
WHEREAS, proper notice of the petition to abandon and vacate the street has
been posted at the Courthouse door of Calhoun County, Texas and at other places in the
vicinity of the affected route, being at the mail box station in Seadrift, Texas and on the

Lot 2, Block 5 of Swan Point Lagoon, Unit One, Seadrift, Texas to be abandoned and
vacated, for at least twenty (20) days before the date the application was made to the
Court; and
WHEREAS, the Commissioners have voted unanimously to abandon and vacate
the portion of the street described on the attached Exhibit "A"; and
WHEREAS, all requirements of Texas Transportation Code 9251.051 and
9251.052 have been complied with in declaring said street to be abandoned and vacated.
NOW, THEREFORE, ON MOTION DULY MADE BY Commissioner
Finster and SECONDED by Commissioner Fritsch , and upon
said Motion having been approved by the Commissioner's Court in a properly posted
public meeting;
IT IS ORDERED AND DECREED, that Calhoun County does hereby CLOSE,
ABANDON and VACATE that portion of street described on the attached Exhibit "A".
IT IS FURTHER ORDERED AND DECREED that on the date this Order is
signed, title to the portion of street closed by this Order is vested in Kevin and Sharon
Noe, the owners of the property that abuts both sides of the closed street, pursuant to
Texas Transportation Code S251.058(b).
IT IS FURTHER ORDERED AND DECREED that a copy of this Order is to be
filed in the Official Records of Calhoun County, Texas and a duly filed copy of the Order
shall serve as the official instrument of conveyance of the closed portion of the street,
Seadrift, Calhoun County, Texas from CALHOUN COUNTY to the respective owners of
the abutting property as set forth hereinabove, pursuant to Texas Transportation Code
~251.058(b ).

WHEREAS, this is selection year for the Board of Directors of the Calhoun
County Appraisal District; and
WHEREAS, the Board of Directors consists of five members who serve two-
year terms, beginning January I, 2014 through December 31,
2015; and
WHEREAS, CALHOUN COUNTY is a voting unit entitled to vote for up to
five candidates from a ballot submitted by the Calhoun County
Appraisal District, if so desired.
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDING BODY OF THIS
VOTING UNIT, THAT:

Step 2 Subsection (e) Chief Appraiser calculates number of votes of each entitled taxing unit
(other than a conservation and reclamation district) and delivers written
notice to each unit of its voting entitlement before October 1,2013.
Step 3 Subsection (g) Each unit other than a conservation and reclamation district that is
entitled to vote may nominate by resolution one candidate for each
position on the board. The presiding officer of each unit shall submit
the names of the nominees to the Chief Appraiser before October 15,
2013.
Step 4 Subsection U) Before October 30, 2013 the Chief Appraiser prepares ballot (alpha
order) and delivers it to the presiding officer of each entitled unit.
Step 5 Subsection (k) Before December 15, 2013, the governing body shall submit to the
Chief Appraiser its vote,
Step 6 Subsection (k) Chief Appraiser counts votes and submits results to each governing
body before December 31, 2013,

and 267'h Jndicial District Conrts respectively of Calhoun County, Texas, and having jurisdiction in the
County of Calhoun, State of Texas, which said County has a population of more than 10,000 inhabitants
according to the last preceding Federal Census, this day having considered the appointment of an Auditor
of Accounts and Finances for said County for a term of Two Years, beginning November 1,2013 and
ending October 31, 2015, do after consideration appoint Cynthia L. Mueller County Auditor in and for

Commissioner Galvan said that the restrooms at Magnolia Beach have been completely demolished and
on November 2nd the construction of the new restrooms will begin and it will take 2 weeks to complete
the restrooms.
