PRESENTATION BY DONNIE MONTEMAYOR OF ERIC TAYLOR, APPLICANT FOR COUNTY EXTENSION AGENT -AG & NATURAL RESOURES POSITION: Donnie Montemayor presented Eric Taylor, selected to fill the position of County Extension Agent - Agriculture & Natural Resources. Mr. Taylor is a graduate of Texas A & M — Kingsville, with a Master's degree in Animal Science with Concentration in Reproductive Physiology. He is a native of Beeville, Texas, Mr. Montemayor stated he has known Mr. Taylor for a very long time, as Mr. Taylor was a 4-H member when Mr. Montemayor was a County Extension Agent. He stated Mr. Taylor has an excellent work ethic and feels very fortunate to have the opportunity to supervise him and to provide him with an opportunity in Calhoun County, Mr. Montemayor also stated "Eric has the skill set to work with livestock and has great knowledge of row crop production with having taken some coursework and actually done some work with that. Eric also has the skill set in 4-H and youth and has the opportunity to assist the 4- H and youth agent in Calhoun County." Commissioner Finster asked when Mr. Taylor will start working for the County. Mr. Montemayor stated he plans to put Mr. Taylor in a training program for at least one month in Beeville, where his home is. Mr. Taylor will be working with the extension agent there which will allow him time to find a place to live in Calhoun County. The Department has the First Step Program which allows a new extension agent to train under a more experienced agent. The extension service will pay the first full month of Mr. Taylor's employment. The projected date for Mr. Taylor to come on board with Calhoun County is the near the end of February. Mr. Montemayor stated that if Mr. Taylor progresses as fast as he thinks he will, he will probably bring him on board sooner, depending on his finding a place to live. Commissioner Finster stated he has a couple of row crop farmers in his area who are interested in getting a couple of test plots in. Mr. Montemayor stated they need to plan for a crop tour also. Commissioner Fritsch made a motion to accept Eric Clayton Taylor as the new Extension Agent for Calhoun County. Commissioner Finster seconded the motion. Commissioners Galvan, Lyssy, Fritsch, Finster and Judge Pfeifer all voted in favor. RESCIND ACTION TAKEN AUGUST 14, 2014 ADOPTING THE MASTER PLAN FOR KING FISHER BEACH AS PRESENTED BY THE PORT O'CONNOR CHAMBER OF COMMERCE AND APPROVE REVISED CONSTRUCTION PLANS FOR PAVILION AND BASKETBALL COURT. Commissioner Finster stated Darla Parker and Mary Jo Walker, Port O'Connor Chamber President were present. Ms. Walker stated she was here to ask the Court to rescind the former approval from last August on the location of the new pavilion and to approve the location of the new pavilion and an additional basketball court. Last August, after the Court approved their plans, the Chamber received some negative feedback from some of the residents along the front beach concerning the proposed location. The concerns were heard at the October and November Chamber meetings. There were several discussions about the location and the Chamber has agreed to move the location of the new pavilion. It has been decided to put the new pavilion where the old one currently is. However, because the new pavilion is larger, the basketball court will have to be moved to the location of the original pavilion. After making the decisions and working with the residents, a meeting was held in Port O'Connor on January 7, 2015. Notices of the meeting were sent out via email, posted around town and also advertised in the Dolphin Talk. The town meeting was to inform the public as to the prior and new location and get support for or against the pavilion. There were 83 signatures for and 2 against. The proposed pavilion will have the same dimensions as before, 50 feet X 100 feet, the building will be blue, and will have 12 foot sides with a 2 on 12 inch slope. There will be an eyebrow all the way around. The proposed basketball court will have a 40 foot X 50 foot slab and will be built on the other side of the restrooms where the original pavilion was approved. It will not have a roof so there should be no obstruction of view for any of the residents that had concerns about that. Ms. Walker stated the Chamber has worked very hard the last few years to raise the money for this new pavilion and asked the Court to rescind the former order and approve these new plans for the relocation of the pavilion and the basketball court. Commissioner Finster stated that the outside edges of the existing pavilion are only about 5.5 feet high and you can hit your head when you walk under it. He further explained that the outside edges will have to be removed, it is in such a condition that it needs to be removed. The older basketball court was originally poured as a dance area by the Chamber years ago and is at a different elevation, so all will have to be removed as well. The pavilion is going to be behind the restroom area where the other one was so everything will be put back put back where it was, but in new condition. Commissioner Finster stated he felt very good about the plan and made a motion to rescind the earlier action and approve the revised construction plans for the pavilion and basketball court. AND CONSIDER REQUEST FOR CONSTRUCTION OF PAVILION AND CABANAS, Mary Jo Walker, President of the Port O'Connor Chamber of Commerce, stated the pavilion in Port O'Connor is in desperate need of repair. The Port O'Connor Chamber of Commerce is proposing to possibly move the shower, replace some lights, add a visitor kiosk and move the old pavilion. They provided the Court with their proposed plan layout for the new beach pavilion that you can refer in the minutes. The old pavilion is 20x80 feet which they are going to remove and then build some cabanas on top of the remaining slab. There is also the large slab which is the basketball court area that will remain In place. The new pavilion will go just the right of the existing shower and restrooms, which you can see on the plan layout. They have about $45,000 and also some people are Interested in making substantial donations when they get a master plan and final drawing. The festivals that are held in Port O'Connor are also helping fund the new pavilion. The Chamber is asking Commissioners Court to accept the proposal of locating the pavilion at a new position and doing what they need to down there. Commissioner Finster stated what this will require is moving one of the older cabanas and relocating a few of the palm trees. Commissioner Lyssy asked how tall the pavilion would be and if it would block the resident's water view. Ms. Walker answered by stating the pavilion will be 16 feet and the houses directly across from this are all on stilts, so they are hoping It will not block anyone's view. Commissioner Finster stated the new pavilion will be a see through pavilion, therefore if it were to block anyone's vlew then they could see straight through it to the bay. This plan has been made public with fliers posted at the Post Office, Speedy Stop and the pavilion. Commissioner Finster made a motion to adopt the master plan for King Fisher Beach that's presented by the Port O'Connor Chamber of Commerce and approve their request for the construction of the Pavilion and Cabanas. Commissioner Fritsch seconded his motion. Commissioners Galvan, Lyssy, Fritsch, Finster and Judge Pfeifer all voted in favor. Ms. Gaines is in charge of the railroad depot and is in charge of history for the City of Seadrift. Ms. Meitzen stated they would like to add someone from the Olivia area and from Port O'Connor also. She stated they can add new members throughout the year, they just have to be appointed by the Court. Members must be willing to dedicate 50 volunteer hours per the Texas Historical Commission. She said officers will be renewed in February and 2014 activities will be listed. Mrs. Meitzen stated March 2nd is Texas Independence Day and there are tentative plans to have a celebration at the County Library. Commissioner Finster made a motion to appoint Peggy Gaines and Vicky Kepler as new members of the Calhoun County Historical Commission. Commissioner Lyssy seconded the motion. Commissioner Galvan stated everything needs to be updated due to age and the grant is needed to modify and improve. Commissioner Galvan made a motion to set the date for the public hearing regarding Community Development Block Grant (CDBG) Program for February 5, 2015 at 5:00 p.m. in the Commissioners' Courtroom. Having found the above elements fully satisfied, COUNTY may contract with a private nonprofit corporation so that they may use said public funds for the purposes contemplated herein, but only if the expenditure is to accomplish "county business" (which encompasses matters of general concern to county residents) and only if COUNTY assures itself that the funds to be transferred by this contract are subject to adequate contractual or other controls to ensure that expenditure of said county funds for the public purpose stated herein will be accomplished and so long as COUNTY received adequate consideration for the county funds to be provided by this contract. To provide a resource center for training and education in the area of child abuse, domestic violence and victimization. d. To provide a warm, non -threatening environment in which the victims of physical/sexual abuse and victimization and their families can work with law enforcement or protection services in preparation for their court appearances. e. To provide a location where local and area law enforcement agencies and those assisting them may obtain evidence to be used to investigate and prosecute those accused of child abuse, domestic violence, family violence and neglect. 4. Most Recent Financial and Performance Reports: THE HARBOR shall submit to COUNTY Auditor and COUNTY Judge each a copy of THE HARBOR's most current independent financial audit or end -of -year financial report of all expenditures and income for the period of THE HARBOR's fiscal year ending in calendar year 2014, within 60 days of the approval of this contract. THE HARBOR shall provide to COUNTY Auditor and COUNTY Judge each a performance review by which THE HARBOR gives details of services provided and clients served for the previous COUNTY fiscal year ending on December 31, 2014, on or before March 1, 2015, 6. Prospective Financial and Performance Reports: THE HARBOR shall submit to COUNTY Auditor and COUNTY Judge each a copy of THE HARBOR's independent financial audit or end -of -year fmancial report of all expenditures and income for the period of THF. Term: The Term of this contract is to begin on January 1, 2015 and end on December 31, 2015, unless earlier terminated by either party on thirty days written notice. 8. Use of Funds: No moneys paid to THE HARBOR shall be expended for any purpose other than for the provision of certain services to and support of the victims of COUNTY who are victims of physical/sexual abuse and neglect; provides, however, that no exception of the person who shall conduct all of the child interviews and provide training to volunteers. 9. Any act of discrimination shall constitute a material breach of this contract. 13. Sexual Harassment Prohibited: THE HARBOR agrees to adopt and maintain a policy that prohibits sexual harassment. Any act of sexual harassment constitutes a material breach of this contract. 14. Applicable Laws: THE HARBOR agrees to comply with any and all applicable laws, local, state and federal, regarding work hours, safety, wages, social security benefits, and/or workers compensation. This clause places a duty to meet the requirements of such laws only if the law itself places such a duty on THE .HARBOR. Any act in violation of any of those laws or ordinances shall constitute a material breach of this contract. 15. Default: a. In the event either party shall fail to keep, observe or perform any covenant, contract, term or provision of this contract to be kept, observed or performed by such party, respectively, and such default shall continue for a period of ten days after notice thereof by the non defaulting party to the other, then in any such event the non -defaulting party shall be entitled to terminate this contract. b. No delay on the part of either party in exercising any right, power or privilege shall operate as a waiver thereof, not shall any single or partial exercise of any right, power or privilege constitute such a waiver nor exhaust the same, which shall be continuing.
