TO THE HONORABLE COMMISSIONERS' COURT OF CALHOUN COUNTY, TEXAS:
The undersigned, S.G.Drushel, E. D. White, Wilmot White Splawn,
a widow, Maymie white Rose, E.T.Rose, S. G.Sample, Maggie L.Young, a
v;i.dow, Mattie Young, Catherine Young Clack, Lila Young Michelson,
Winifred Young and Patty Young (the mid Catherine Young Clack being
joined herein by her husband E.E.Clack and the said Lila Young
Michelson being joined herein by her husband, Peter Michelson), all
of the last named seven acting herein by and through their duly

authorized attorney-in-facti the said Maggie L. Young, all of the County
of Jackson and State of Texas, and Oliver H. Radkey, Jr., of the County
of Travis and State of Texas, respectfully represent to this Honorable
Court that on or about the 21st day of August, A.D.194 5 they had a
survey made upon the ground and the attached Plat or Map of Unit Three
of,Port Alto, prepared by Robt. J. Bryan, of Ganado, Texas, a licensed
State Land Surveyor, and they have since executed the attached dedication
of said "Unit Three of Port Alto", and they here now pray this Honorable
Court to authorize by suitable minutes the filing of the attached Map
of said Subdivision and the recording of same by the County Clerk of
Calhoun County, Texas.

hereby dedicate and set apart to the perpetual use of the public for
highway purposes, only, all streets and roadways designated upon said plat.
RESTRICTIONS AS TO USE CF PROPERTY
Without divesting ourselves by this instrument and its terms of
our title to the lands shown ;on the attached plat; and without obligating
ourselves personally to enforce the restrictive�.Iprovisions of this ded-
ication, and disclaiming any intent to obligate ourselves to pay any damage`
to any one by reason of the observance or failure of any person to observe
any restrictive provision set forth in this instrument, we declare certain
restrictions as to the use to be made of.lands owned by us constituting
said"Unit Three of Port Alto" as shown on attached plat as follows:
1.
No lot or part of lot inraid`'Subdivision shall be used by any
one other than members of the white race and their necessary servants;
2.
No outside toilet shall be erected, maintained or used on any.of
the Numbered lots in said Subdivision at any point nearer -than twenty (20}'

feet to any boundary line of such lot.
3.
No house other than -residence or dwelling houses and outside houses
necessary to the reasonable -enjoyment thereof shall be erected on any lots
of said Subdivision restricted to use for residential purposes only.
4.
No one will have any right to erect any house on any of said lots
or to maintain or use any such house without painting and keeping painted
such house.
5.
We disclaim any liability to any and all persons on account of damages
if any which may result to any one because of any use which may be made
of any of the dedicated streets, ditches, harbors, drives or walkways,
shown on the plats of either "Unit One", "Unit Two" or "Unit Three" of
Port Alto, or because of any denial to any one at any time of the use of.
same, or,in,case we�construct or contribute to the construction of any of
said streets, ditches, harbors, drives or walkways and entrances thereto.
