at its regular meeting place on December 6th, 1948, at 8 otclock
P. M. with the following present:

PETITION FOR CORRECTION OF SUBDIVISION
BY RE SUBDIVISION
THE STATE OF TEXAS THE BOARD OF COMJUISSIONERS
COUNTY OF CALHOUN, OF THE CITY OF
CITY OF PORT LAVACA, PORT LAVACA, TEXAS.
TO" THE HONORABLE BOARD OF COMISSIONERS OF THE CITY OF
PORT LAVACA, CALHOUN COUNTY, TEXAS:
Now comes, J. E._ Ezze-11, Tom DeShazor, President of the-
DeShazor Construction Company, Homer -Glaze and John J. Faubion'
all of Port Lavaca, Calhoun County, Texas.* being the sole and
only owners of a tract. consisting of 31 acres out of the Maximo
Sanchez -League of Calhoun County, Texas as purchased by J. E.
Ezzell from J. L. Record', by deed -of record in Volume 53
Page 521 of the Deed Records of Calhoun County, Texas, the Nonth-
west one—half of which was thereafter sub—divided'as the ESSELL
ADDITION to the city of Fort Lavaca$ Texas# approved for record.
on the 5th day of September, 1947, by the Board of Commissioners,`,_
of the City of Fort Lavaca, Texas$ and filed in the Deed Records
of Calhoun County, Texas;,.recorded in Volume Z. Page-94, by Plat
disclosing Blocks A. B, C. D. and E as all the blocks therein,
and would respectifully petition and show the Board of Commissioners
as follows;
19' That the plat of said sub —division contained upon
its face the following statement' 'The Streets and alleys as shown
upon this map are dedicated for the use of the public only" which
said attempted dedication was. not signed or acknowledged by the
the then owner, J. E,. Ezzell; and did not constitutie a valid
dedication; without actual acceptance by the city without taking
over and opening of said streets and alleys., or the sale of such
subdivision by reference- to�lots and blocks therein;
28 That thereafter J. Ee Ezzell sold and conveyed to
Tom DeShazor the northwest 20.75 acres of land out of the original
31 acre tract as acerage~, and the same had not theretofore been
opened to the public,'nor had 'any lots been sold as such, said
conveyance being recorded in Volume 62 page 462 of the Deed Records
of Calhoun County, Texas.
